State of Colorado <br /> Division of Reclamation, Mining and Safety <br /> Department of Natural Resources <br /> April 18, 2017 <br /> Page 2. <br /> The site of the proposed mining operation is owned by Dennis and Caroline Ennis <br /> Perrino, ("Perrinos"), and is located in Huerfano County, Colorado, northwest of <br /> Walsenburg, with a legal description as follows: SE1/4/NE1/4 and Parts of the <br /> NE1/4NE1/4, SW1/4NE1/4, and NW1/4NE1/4Section 2, Township 27 South, Range 68 <br /> West of the Sixth P.M., Huerfano County, Colorado. (The "Perrino Property"). <br /> The entrance to the Perrino Property, for purposes of ingress and egress for the <br /> mining operation, was designated as 37°43'47.17"N, 104°58' 2.83" W. ("Access Point"). <br /> (See Exhibit A, as attached). <br /> The Access Point is connected to County Road 614.1 to the west by a dirt road, <br /> which runs through in its entirety on a property called Sun River Ranch. ("Access Road"). <br /> In Exhibit D of the Application this Access Road is described, inter alia, that it is <br /> "owned by the landowner, [presumably Dennis Perrino], to access his property from CR <br /> 614.U' As it will be shown below the Perrinos do not own the Access Road between CR <br /> 614.1 and the Access Point, (Exhibit B), and the Applicant's description of the ownership <br /> of the Access Road to the contrary is misplaced and without support. <br /> STANDING <br /> (i) SRRRA: <br /> The Sun River Ranch property, ("Sun River"), is located south of the Perrino <br /> Property and the Access Road is located entirely within Sun River. Sun River was <br /> subdivided into 19 individual lots, and they were sold to individual owners. <br /> SRRRA, a Colorado nonprofit corporation, was formed to provide a means of <br /> self-government of the owners of the individual lots, and to provide maintenance of the <br /> common elements within Sun River, which are the roads, including the Access Road. <br /> SRRRA's Declaration of Covenants, Conditions and Restrictions< <br /> ("Declaration"), expressly prohibits, as herein relevant"mining, quarrying or related <br /> operations of any kind." <br /> SRRRA would be directly and adversely affected or aggrieved by the use of the <br /> Access Road for commercial activities, such as mining, as such activity would, inter alia, <br /> encroach on SRRRA's property rights, and violate its Declaration. <br />
