• Maintains the memorandum of understanding between CC&V and the City of <br />Cripple Creek dated May 2012 regarding commitments made for final <br />reclamation in Poverty Gulch. <br />2. Changed Condition <br />Newmont/CC&V is proposing this Map Change due to changes in conditions with its <br />mine property. Newmont applied to amend its existing OMLR Permit No. M-1980-244 <br />on December 16, 2015 and submitted an amendment to this application on February 16, <br />2016. The OMLR approved Amendment 11 on February 8, 2017. A portion of this <br />permit amendment included the addition of underground mining as a method used by <br />Newmont for extracting resources. The Chicago Tunnel was identified as a suitable <br />location for initiating underground exploration and development of the north area of the <br />mine to assess the feasibility of underground mining. The Chicago Tunnel/Proper Adit <br />mine area is currently permitted for underground mining pursuant to a Section 110 <br />Limited Impact Mine Permit No. M-1988-026. Despite the current mining permits and <br />despite the historic use of this area as a mine area, the land required for underground <br />exploration lies outside of the CCMOD boundary. Newmont's plan per its permit <br />amendment application is to integrate the Chicago Tunnel/Proper Adit permit into its <br />Cresson Project permit M-1980-244 so the company is operating under one, Section <br />I I2(d) reclamation permit. Newmont believes this is in the best interest of the public <br />because it places stricter controls on activities at the Chicago Tunnel portal as the area <br />would be subject to the more stringent rules associated with a Section 112(d) reclamation <br />permit. <br />3. Effect on Natural Environment <br />Newmont has performed extensive studies on the potential environmental impacts of its <br />permit Amendment 11. No adverse impacts to the natural environmental are anticipated <br />as a result of this proposed Map Change that could not be mitigated during the post - <br />mining reclamation process. The studies that were performed as part of the Amendment <br />11 application and the Mine Development Plan amendment application and included: <br />• Soils, Wildlife and Vegetation Assessment in the area <br />• Stormwater Management Control Studies <br />• Traffic Studies <br />• Economic impact assessment <br />• Visual resource assessment <br />• Cultural resource assessment <br />Cresson Project Amendment 11 <br />CCMOD Map Change Application <br />Page 6 <br />
