Requirement No.6 <br /> The Operator may not commence mining and milling activities until the Division receives and <br /> approves, through the Technical Revision or Amendment process as determined by the Division, design <br /> specifications certified by a licensed professional engineer for all Environmental Protection Facilities, as <br /> required by the Act and Rules, and the Operator satisfies the specific requirements of Rules 7.3 and 7.4. <br /> The Environmental Protection Facilities include, but are not limited to, the following: mill building; <br /> storage sheds and tanks in which designated chemicals are stored or utilized,tailings facilities;and <br /> augmentation pond and its associated pipeline and discharge structure. <br /> Response No.6 <br /> On April 1,2013 the Division approved the Technical Revision request(TR-6)addressing the <br /> removal of the mill from the operations plan. <br /> Exhibit U "Environmental Protection Plan" (attached)addresses adopted environmental protection <br /> methods and procedures for the mine site. <br /> Requirement No.7 <br /> The Operator may not commence mining and milling activities until the Division receives and <br /> approves, through the Technical Revision or Amendment process, an updated Exhibit L and financial <br /> warranty addressing all applicable requirements of Rule 4, and specifically, but not limited to, Rule <br /> 4.2.1(4)regarding reclamation costs associated with the protection of water resources, including costs to <br /> cover necessary water quality protection, treatment and monitoring as required by permit, and the Act <br /> and Rules. The existing Exhibit L,submitted by the Operator does not address this issue and is not <br /> adequate for approval. <br /> Response No.7 <br /> Exhibit L"Reclamation Costs" (attached)summarizes anticipated reclamation costs. The <br /> Operator has received a Colorado Department of Public Health and Environment (CDPHE) industrial <br /> Discharge Permit(COR 031-1717). The CDPHE permit stipulates water quality discharge monitoring and <br /> reporting requirements. The discharge point(Idaho Springs) currently complies with the applicable <br /> water quality standards.
