Portal and May Day 2 areas, stabilization of the Chief Portal,stabilization of the access road immediately <br /> above the Chief Portal, and the Division approves the as-built certifications submitted subsequent to the <br /> completion of the approved plans. The Chief Portal was constructed illegally and addressed under <br /> Violation MV-2010-020. The stabilization issue may require coordination with other agencies, including <br /> but not limited to, the WQCD, COE, EPA, and USFS. <br /> Response No.2 <br /> The Operator completed stabilization of the Chief Portal and access road immediately above. <br /> On June 29,2016,the Operator submitted to the Division an "as-built" report for this stabilization work <br /> titled, "Technical Revision-TR-S, Removal of Mine debris from Little Deadwood Gulch in the Chief Portals <br /> Area, installation of a culvert within LDG Channel,Stabilization Highwall and Access Road Above the <br /> Chief Portal,and Repair of the Emergency Manway." On July 18, 2016,the Division responded <br /> requesting the Operator re-vegetate the slope above the Chief Portal and submit an engineering <br /> stability analysis of the slope within 30 days. The Operator timely completed stabilization of the slope <br /> above the Chief Portal on July 28,2016,and the Operator provided its engineering stability analysis to <br /> the Division on August 13,2016. <br /> The Operator completed reclamation of the Little Deadwood Gulch at the May Day 2 and Chief <br /> Portal. On October 11, 2016,the Operator submitted to the Division an "as-built" report for the May <br /> Day 2 area reclamation work entitled, "Technical Revision No.4,As-built Report, Restoration and <br /> Stabilization of Little Deadwood Gulch, May Day 2 Mine Area"; and on October 14, 2016,the Operator <br /> submitted to the Division an"as-built" report for the Little Deadwood Gulch and Chief Portal <br /> reclamation work entitled, "Restoration Completion Report, Little Deadwood Gulch and Chief Portal." <br /> On October 18, 2016 the Division inspected the mine site and prepared an inspection report indicating <br /> that the reclamation work at the Chief Portal and May Day 2 areas had been completed. <br /> On December 15, 2016,the Board approved the reclamation work. <br /> Requirement No. 3 <br /> The Operator may not commence mining and milling activities until the Division receives and <br /> approves, through the Technical Revision or Amendment process as determined by the Division, the <br /> revised work plan(s)addressing stabilization of the collapsed adit at the May Day 1 area, construction of <br /> a new portal and mill facility in accordance with the Act and Rules, and the Division approves the as-built <br /> certifications submitted subsequent to the completion of the approved plans. The portal and mill facility <br /> were illegally constructed and addressed by Violations MV-2009-035 and MV-2010-001. The portal and <br /> mill facility issue may require coordination with other agencies, including but limited to, the Mine Safety <br /> and Health Administration and USFS. <br /> Response No.3 <br /> The Operator completed stabilization and maintenance of the May Day 1 portal. On June 30, <br /> 2016,the Operator submitted to the Division an "as-built" report for this stabilization work entitled, <br /> March 10,2017 <br /> Amendment to Permit No. M-1981-185 <br /> May Day Idaho Mine Complex <br />
