Photos of the points are labeled with <br />the points names are enclosed. <br />Point <br />Description <br />112 Ne -4 <br />This <br />point is the first one west of the <br />northeast corner in the existing permit <br />134 nco <br />This <br />point is the northeast corner of the plant <br />site <br />(existing permit) <br />New <br />Permit corners (red line) <br />82 nmp <br />This <br />is a point on the new north line that is <br />just <br />south of the upper bank of the old north <br />lake. <br />125 newturn <br />This <br />is the turning point on the new north line <br />that <br />will take in the old safety berms that <br />were <br />placed to protect old north lake years <br />prior to permitting. <br />148 ncn <br />This <br />is a new corner that moves the northeast <br />corner of the Plant Site <br />The second Map shows all of the old and new points located at the <br />mine, and marked with rebar. Photographs of the corners are enclosed <br />that are labeled to match each corner shown on the map. I missed <br />getting photos of the northeast corners (66 nen & 67 neo) if you need <br />photos of them let me know and I'll submit them for the file <br />Conclusion <br />From my site review it appears that mining has not taken place within <br />25 feet of the north line. It is very close and the dirt pile along <br />that side is placed in the setback. Along the west side the material <br />pushed into the trees did not cross the permit line but it is very <br />close too. we are not able to mark the 25 foot setback on the area <br />where mining existed, when the permit amendment was approved, since <br />it's so close to the bank and the dirt pile to safely access. <br />To correct the problem with this proximity problem, McAtee proposes to <br />file an amendment that would move the north line farther north to the <br />location shown as a red line. The west line would then be extended <br />from the northwest corner to the property line along the road to take <br />in additional area on that side. No mining is taking place at the <br />site now as they are removing stockpiled, so we propose filing the <br />amendment in the next 60 days. <br />
