The following discusses <br /> two specific conditions, including details of why the timeframe is unattainable and requests additional <br /> time to address the Divisions requirements. <br /> 1. Exhibit E Reclamation Plan,Item#51 (Vehicle interaction on CR 82 with WHEA highwall) <br /> Within CC&V's January 23, 2017 submission of responses to DRMS adequacy review comments, <br /> CC&V indicated it would fulfill HDR Engineering's CR82 roadside ditch re-sloping <br /> recommendations within 30 days of the approval of Amendment-11. Initially this timeframe was <br /> anticipated to fall sometime in late April 2017. However, the requirement to attend the MLRB board <br /> hearing was cancelled, and Amendment-11 was approved by DRMS on February 8, 2017 which <br /> brought forward the 30 day timeframe to March 8, 2017. <br /> As a result of this compressed timeframe and following engagement with subject matter experts from <br /> Teller County, CC&V has determined that environmental factors outside the control of CC&V, <br /> specifically snow cover and frozen ground will prevent CC&V from completing the program within <br /> the timeframe referenced within the condition. <br /> Despite this restriction, CC&Vs has documented progress towards satisfactory completion of the <br /> condition as indicated in the January 23, 2017 adequacy review response. <br />
