EXHIBIT D -- Mining Plan <br />1. Mining has transitioned from the original Elrick Pit that Washington County <br />assumed in 2003. The original mining plan was as follows: <br />a. Gravel was removed from the intermittent streambed with a bulldozer <br />and front-end loader. The gravel will be hauled via belly dumps and <br />semis to areas of construction in Washington County. Gravel may also <br />be removed from the bank areas in the same manner. <br />b. If bank areas are disturbed, topsoil from the banks will be salvaged for a <br />depth of 6: - 12" and stockpiled until used in reclamation. No other <br />earthmoving will occur, except actual gravel removal as previously <br />described. <br />c. No water diversions for impoundments should be needed. <br />d. Gravel will be removed from the bed of the creek first, then move about <br />the permitted are due to consequences of high water periods. Work will <br />occur in approximate 5 -acre segments. The timetable for this permit <br />should span at least 8 years. <br />2. Washington County filed an amendment to the permit in May of 2013. At that <br />point, the mining plan switched from mining within the creek bed to a specified <br />area in the northeast corner of the defined boundary within the S 112 of Section <br />11. The existing mining plan is as follows: <br />a. The proposed affected area will not be in the Surveyor Creek. <br />Material will be mined from the rangeland to the North of the creek <br />bank to 60 feet south of the fence separating the Railroad right-of-way <br />and the proposed site. Stockpiled material will be outside the creek <br />banks as to protect the natural flow of Surveyor Creek. <br />b. Topsoil will be stockpiled along Surveyor Creek bank outside of the <br />creed bed itself Material being mined for consumption will be <br />stockpiled to the north within the affected area to allow trucks access <br />into and out of the affected area. <br />c. From this point forward, no material will be removed from Surveyor <br />Creek. <br />d. Vegetation will be used to stabilize the stockpiled topsoil. The topsoil <br />has seeds from vegetation already occurring. The natural vegetation <br />from the area will grow over the stockpile. <br />e. The mining operation will maintain, at a minimum, a 3:1 slope from <br />the riverbanks north to the top of the pit wall, allowing precipitation to <br />run towards Surveyor Creek. In accordance with Colorado State <br />Water restrictions, no structure will be used to divert precipitation <br />from its natural flow. <br />f. Surveyor Creek will not be diverted during the mining operation, so as <br />not to cause any problem with natural flow of the creek. There should <br />not be an issue scouring of the bridge just to the north of the proposed <br />pit area. <br />
