for Lining Criteria for Gravel Pits in a letter dated May 25, 2016. The
construction of the slurry wall resulted in ground water mounding and
flooding of adjacent property. The operator has installed a gravity drain
to dewater the site on a continuous basis. A permanent drain is being
installed at the site, which has the potential to compromise the existing
and approved liner, and therefore a new 30 -day leak test will be required
upon completion of work on the permanent drain. For the purposes of
this SWSP, you have assumed that 15.0 acres of ground water will be
exposed in the pit for the duration of the approval period. Depletions
covered by this SWSP include water lost due to evaporation and dust
control.

Brighton Pit Status: Mining operations at the Brighton Pit are complete and

batching. Water for concrete batching will come from Well Permit No.
13410 -F -R (WDID 0207073). Note that the water right for this well was on
the division engineer's 2010 Decennial Abandonment List, but the well
may still be used in accordance with its permit as long as all depletions
are treated as junior to all other vested water rights in accordance to this
SWSP and the well complies with the South Platte Well Measurement
Rules.
