ATCOLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />DATE: February 24, 2017 <br />RE: Division's Rationale for Recommendation to Board to Approve 112c Application with <br />Objections, Parkerson Construction, Inc., C Road Pit, File No. M-2016-050 <br />Introduction <br />On February 24, 2017, the Division of Reclamation, Mining and Safety ("Division") issued its <br />recommendation to the Colorado Mined Land Reclamation Board ("Board") to approve the <br />permit application submitted by Parkerson Construction, Inc. ("Applicant") for the C Road Pit <br />(File No. M-2016-050) over public objections. The Division's Rationale for its Recommendation <br />to the Board is intended to explain the process by which the Division arrived at its <br />recommendation to approve the permit application, over public objections, and respond to the <br />issues raised by the objecting party. The Division reserves the right to further supplement, <br />amend, modify, or clarify this document and recommendation as necessary. <br />Herein, all references to the Act and Rules refer to the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, 34-32.5-101 et seq., C.R.S. ("Act"), and to the Mineral <br />Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br />Construction Materials ("Rules"). A copy of the Act and Rules are available at the Division's web <br />site -- http://mining.state.co.us. <br />Summary of the Review Process <br />The Applicant filed an application with the Division on September 13, 2016. The application <br />described a construction materials mining operation with on-site processing of mined materials <br />to include crushing, screening, and washing. The proposed permit boundary, which includes a <br />haul road, totals 84.9 acres. Of the 84.9 acre total, the proposed mining operation is <br />anticipated to affect approximately 75 acres, leaving approximately 9.9 acres to serve as a <br />buffer zone, i.e., land located within the permit boundary but not affected or directly impacted <br />by the mine operation.
