EXHIBIT N SOURCE OF LEGAL <br /> RIGHT TO ENTER <br /> Material removed from the premises the preceding month by the 30"' day of the month <br /> for the preceding month. <br /> 5. Buyer shall have full right of ingress and egress over and on the Property for the purposes <br /> of mining, storing and removing the :Material and may erect and place such structures as <br /> may be necessary for these purposes. Buyer shall also have the right to construct such <br /> roads as may be necessary for the purposes of mining, storing and removing the Material. <br /> 6. Owner covenants that he/she has full title to the Property including ownership of the <br /> surface and any and all mineral rights including all Materials, and Owner warrants that <br /> he/she will defend the title to the Property and Material. Buyer shall have the right. but <br /> riot the duty, to make any cure or redemption in the event of foreclosure on the Property. <br /> 7. Buyer covenants and agrees that Owner shall have the right of use and occupancy of <br /> portions of the Property not actually being used by the Buyer in this gravel operation so <br /> long as such use does not interfere with the right of the Buyer to conduct its operation. <br /> The Mining Plan shall provide reasonable accommodation and spacing around structures <br /> on the Property. <br /> 8. Owner understands and acknowledges that the conduct of Buyer's operation will cause <br /> noise and dust, which shall not be a condition upon which the Owner may terminate this <br /> Agreement or enjoin the Buyer from removing Material. <br /> 9. At the end of the term of this Agreement, the Buyer shall restore the property as required <br /> by its Pen-nits with the Colorado Division of Reclamation. <br /> 10, The Property is described in Attachment"A." <br /> 57 <br />
