Section 01740 Warranties <br />PART 1— GENERAL <br />1.1 DESCRIPTION <br />A. This section describes the disposition of warranties submitted on the project. <br />B. Requirements under the Agreement will take precedence if in conflict with this <br />Specification. <br />C. It is explicitly understood that nothing in any warranty shall relieve the Contractor from <br />rights and privileges of the Owner as set forth in these Contract Documents in relation to <br />products and services as intended or described in these Contract Documents. <br />D. It is explicitly understood that manufacturer's warranties are an attempt to limit their <br />liability under law. As a condition of warranties submitted by manufacturers or others on <br />this project it is understood that the requirements of this Section or the Contract, <br />whichever is more stringent, supersede warranties submitted. The Engineer will not <br />review warranties as to substance of manufacturers trying to limit their liability. Such <br />attempts to limit liability that is in violation of these Contract Documents is void and <br />without legal effect. <br />E. The submittal of warranties on this project shall not in any way relieve Contractor of their <br />responsibilities for Contractor's General Warranty and Guarantee and Correction Period <br />as defined in the Agreement and related requirements contained in these Contract <br />Documents. <br />1.2 SUBMITTAL OF WARRANTIES NOT CALLED FOR IN THE CONTRACT <br />DOCUMENTS <br />A. If the time period of the warranty falls within the Correction Period specified for the <br />project, the warranty shall be without effect on the project. Contractor may use said <br />warranty for their own use if Contractor elects. The Engineer will not review said <br />warranties if submitted. <br />B. If Contractor submits warranties and the time period of the warranty exceeds the <br />Correction Period specified for the project, these warranties shall be accepted under the <br />following conditions. <br />1. Engineer shall not review the warranty for substance. <br />2. During the Correction Period of the project, the warranty shall be for the use of the <br />Contractor as it relates to Contractor's responsibilities under the Correction Period. <br />3. After the expiration of the Correction Period, the rights under the warranty shall pass <br />to the Owner for Owner's use of their facilities. <br />Warranties February 2017 01740-1 <br />
