Unless otherwise stated in the Special Provisions of this Subcontract Agreement, the Subcontractor shall be responsible for all field measurements,survey, layout and engineering checks as may be required to construct its work. Survey control provided to the Subcontractor by others will only be that as specifically defined in the Special Provisions as defined in Schedule B of this Subcontract Agreement. The Subcontractor shall check all work performed by others upon which the Subcontractor's work is dependent for the reasonable conformity of elevations and grades with the Contract plans and specifications as adjusted for extra work. Subcontractor shall use good judgement and any engineering checks as necessary to ensure the proper fitting of its work, unless such engineering checks or survey are expressly excluded in the Special Provisions of this Subcontract Agreement. If the performance of any item of work by the Subcontractor is related to or dependent upon any other item of work performed or materials furnished by others, Subcontractor warrants,by undertaking to perform its work without serving notice to the Contractor of any such discrepancy, that such other items are satisfactory and acceptable and waives all claims against Contractor for additional compensation or for damages resulting from any defects therein. All proposed deviations from the Prime Contract documents must be submitted in writing in acceptable form and approved in writing by the Contractor prior to Subcontractor performing the work. The Subcontractor shall state in writing the reasons for any deviation and refer to the applicable Contract provisions. The Contractor's or Owners final approval of drawings made by the Subcontractor shall not relieve the Subcontractor from responsibility for unauthorized changes, deviations or omissions or for errors of any sort in its drawings. 16. Subcontractor shall be responsible for performance regardless of any interference of any trades council or other labor union or union organization. The Subcontractor expressly agrees to be bound by the Affirmative Action requirements and Equal Employment Opportunity provisions attached hereto and incorporated by reference herein and hereby delivers to the Contractor a subcontractor certification in the form contained therein, which certification shall be deemed part of this Subcontract. Subcontractor shall indemnify the Contractor from any use or infringement of patents.
