Resolution No. 1998-vi-1(c) <br /> RESOLUTION CONCERNED WITH THE GRANTING OF A SPECIAL USE PERMIT <br /> FOR TWO SINGLE FAMILY DWELLING UNITS NOT RELATED TO AN <br /> INDIVIDUAL RANCH OR FARMSTEAD AND A SPECIAL USE PERMIT FOR <br /> COMMERCIAL MINERAL EXTRACTIVE OPERATIONS ON A TRACT OF LAND <br /> LOCATED THE NWl/a AND THE SWIA OF SECTION 10, TOWNSHIP 9 NORTH, <br /> RANGE 81 WEST OF THE SIXTH PRINCIPAL MERIDIAN, JACKSON COUNTY, <br /> COLORADO <br /> WHEREAS, the Board of County Commissioners has received an application submitted <br /> by Richard F. Wyatt and Rodney B. Wyatt, P.O. Box 1052,Walden, CO 80480 for a Special Use <br /> Permit for two (2) Single Family Dwelling Units Not Related to an Individual Ranch or <br /> Farmstead and for a Special Use Permit for Commercial Mining, including sand and gravel <br /> extractive operation affecting 10 acres or more and extracting 70,000 tons or more of mineral, <br /> overburden, or combination thereof during any calendar year, and all other mineral extractive <br /> operations, including the exploration for, milling, refining, or mixing for shipment of said <br /> materials on a tract of land in the Ranching District and located in the NW/4 and the SW/4 of <br /> Section 10, Township 9 North, Range 81 West of the Sixth Principal Meridian,Jackson County, <br /> Colorado and more particularly described as follows: <br /> Beginning at the west one quarter(W1/4) corner of said Section 10; thence along the west <br /> line of said NW/4 of Section 10 N 00°42'02" E 1775.50 feet; thence departing said west <br /> line S 88°41'35" E 18.79 feet to a #5 rebar set with a yellow cap affixed stamped <br /> "B.M.S.I. 16394"; thence S 88°41'35" E 520.59 feet; thence S 54°00'28" E 1194.55 feet <br /> to a point at the top of the existing cut bank of a gravel road; thence along said existing <br /> cut bank S 26°33'37" W 128.69 feet; thence continuing S O1°47'29" W 117.35 feet; <br /> thence continuing S 06°00'10" E 186.33 feet; thence continuing S 16°22'16" E 218.59 <br /> feet; thence continuing S 09°21'43" E 250.57 feet; thence continuing S O1°41'52" E <br /> 244.67 feet; thence continuing S 12024'45" E 236.60 feet; thence continuing S 10°45'22" <br /> E 91.19 feet; thence continuing S 08030'50" E 96.24 feet; thence departing said cut bank <br /> S 85059'17" W 1178.57 feet to a #5 rebar set with a yellow cap affixed stamped <br /> "E.M.S.I. 16394; thence N 42002'34" W 749.29 feet to the Point of Beginning and <br /> containing 3,062,459 square feet or 70.30 acres more or less. <br /> WHEREAS, the applicants are requesting Special Use Permit authorization for two (2) <br /> Single Family Dwelling Units Not Related to an Individual Ranch or Farmstead and Special Use <br /> authorization for Commercial Mining, including sand and gravel extractive operation affecting <br /> 10 acres or more and extracting 70,000 tons or more of mineral, overburden, or combination <br /> thereof during any calendar year, and all other mineral extractive operations, including the <br /> exploration for, milling, refining, or mixing for shipment of said materials; and, <br /> WHEREAS, pursuant to proper public notice, a public hearing was held regarding said <br /> application in accordance with the provisions of the Jackson County Zoning Resolution on the <br /> 11th day of May, 1998; and <br /> WHEREAS,the Board of County Commissioners has determined that the said Special Use <br /> Permit for two(2) Single Family Dwelling Units Not Related to an Individual Ranch or Farmstead <br /> should be granted subject to the following conditions and restrictions: <br /> 1. That only two (2) dwelling units not related to an individual ranch or farmstead <br /> shall be located on the above-described tract pursuant to the authorization herein. <br /> Said Single Family Dwelling Units may be a stand-alone structures or may be <br /> attached to one or more of the accessory structures authorized herein. <br /> 1) ThP 4nPninl TTce Permit authorization for two (2) Single Family Dwelling Units <br />
