the Division in December of 1992 drew on the LOC and received from FNBG a check for $36,000 in <br />January of 1993. This money was held by the Division as a cash bond. <br />In February of 1993, the Division informed Mr. Robert Weaver that the reclamation liability at the <br />site had increased to $60,734, and further described to Mr. Weaver ways in which this liability could <br />be reduced. Mr. Weaver agreed to begin site reclamation to reduce the site's liability. In July 1993, <br />the Division verified that some reclamation had been accomplished, and informed Mr. Weaver that <br />the site's liability had been reduced to $46,482. Mr. Weaver continued conducting reclamation in <br />1993 and 1994, eventually reducing the site's reclamation liability to $34,864 by November of 1994. <br />Additional reclamation was conducted by Mr. Weaver in 1995. During this process, no formal bond <br />release application was submitted by Mr. Weaver. As such, there were no formal approvals by the <br />Division of a Phase I, Phase H, or Phase III bond release prior to this (SL -01) TOJ process. <br />Due to compliance problems at the site, and in accordance with Mr. Weaver's wishes, the CMRLB in <br />February of 1996 ordered the site's permit revoked and the $36,000 cash bond forfeited. In March of <br />1996, the $36,000 was placed into a bond forfeiture account. Most of the remaining reclamation <br />work occurred in the summer and fall of 1996. During subsequent years, the Division determined <br />that the site required re -seeding, which was conducted by the Division in October of 2006. <br />Dollar Amount for Return <br />As Mr. Weaver had conducted some of the site's reclamation prior to the February 1996 permit <br />revocation and bond forfeiture, and as the surface owner requested the site's sediment pond and <br />access road be left in place, the entire $36,000 amount of forfeited bond was not required to <br />finish reclamation of the site. Surplus money in the amount of $11,227 is therefore available <br />for return to FNBG (Rule 3.05.6(3)(d)). DRMS intends to provide this surplus money to the <br />Bank of the West in Gunnison, Colorado, which has assumed FNBG's responsibilities. <br />IV. RECLAMATION ACTIVITIES <br />The reclamation plan stipulated returning the area to pre -mining contours, maintaining the pond and a <br />road for landowner access, sealing the mine openings, distributing topsoil over the disturbed areas at <br />an average depth of one to two inches, and seeding disturbed areas to reestablish a ground cover in <br />accordance with the approved reclamation plan (permit section 2.05.4, Reclamation Plan). The <br />reclamation seed mix agreed upon in 1995 is available in permit section 2.05.4 and presented below <br />as Table 1. <br />The reclamation plan describes the structures existing during the operation and the methods of <br />their reclamation.
