V. OBSERVATIONS and FINDINGS <br />Site Inspection History <br />While the Ohio Creek No. 2 Mine was an active, and then a non -producing, mine, it was inspected <br />monthly according to Rule 5.02.2. In April of 1992, following notification by the company to the <br />Division of the mine going into Temporary Cessation, inspection frequency was reduced to four <br />complete inspections annually (Rule 5.02.2). Following the site's reclamation from 1993 through <br />1996 and consequent vegetation re-establishment, the inspection frequency was reduced in 2004 to a <br />twice -yearly basis as allowed by Rule 5.02.2(8). Going forward from 2004, complete inspections <br />were carried out in the spring (March, April or May), in conjunction with snowmelt runoff, and again <br />in the fall (September, October or November) after the summer thunderstorm period. <br />Public Notice and Public Comments <br />This Phase VII/III bond release/termination of jurisdiction process (SL -01) was initiated by the <br />Division on March 22, 2016. The Division published notice of its initiation of the process once <br />weekly for four consecutive weeks in the Gunnison County Times as per Rule 3.03.2(1), beginning <br />March 31, 2016. Also notified were land owners within and adjacent to the mine permit area, and <br />other interested parties of the application for bond release, as required by the Rule. The Division sent <br />letters directly to the following entities about its intent to terminate jurisdiction, inviting them to <br />attend the July 12, 2016 bond release inspection: <br />1. <br />Ranch Properties LLC <br />2. BLM Gunnison Field Office <br />Table 2: List of concerned parties informed of the bond release inspection and TOJ process. <br />Phase I <br />Rule 3.03.1(2)(a) requires backfilling, grading and drainage control to be established per the <br />approved reclamation plan for Phase I bond release.
