Box 567
Cheyenne Wells, CO 80810
RE: Extension Approved, Corrective Action Deadline for Violation MV -2016-052,
Munsch Pit, Permit No. M-2000-018
Dear Ms Brossman:
On December 28, 2016, the Division received your request for 60 -day extension of the corrective
action deadline for Violation MV -2016-052. The corrective action required Cheyenne County to file
a 112c conversion application for the existing 110c permit, due 90 days from the effective date of
the Board's Order, due January 19, 2017.
The Division's records verify Cheyenne County not only paid the civil penalty for MV -2016-052
timely, but also sought and attained the Division's approval for emergency interim action to repair
the erosion to Ladder Creek, thereby protecting off-site areas from continued damage resulting
from the mining operation. The Division appreciates Cheyenne County's diligent efforts to comply
with the letter and intent of the Board's Order.
Therefore, the Division approves Cheyenne County's request for 60 -day extension of the filing
deadline for the 112c conversion application. Please ensure the 112c conversion application for
Munsch Pit, Permit No. M-2000-018, is filed with the Division no later than March 20, 2017.
Please contact Tim Cazier, (303) 866-3567, extension 8169, or by email at tim.cazier(Pstate.co.us, if
you have any questions.
5inerl
Wallace H.
