<br />3 <br />per Rule 6.4.20(c). CC&V also is in the process of obtaining letters of <br />acknowledgement from Century Link (phone line), Colorado Natural Gas (natural gas), <br />and the City of Victor Administration (water). In addition to addressing the <br />requirements of Rule 6.4.20 (c), CC&V believes it has satisfied the requirement of <br />6.4.20 Exhibit T by conducting blasting and ground motion studies as part of prior <br />permit amendments and Amendment 11. As noted in the Amendment 11 application, no <br />changes to surface mining activities with the exception of sequencing in the North <br />Cresson mine are expected. Specifically, the Matheson Mining (MMC) letter report <br />submitted with Amendment 10 concluded that, “Peak particle velocities measured at <br />the closest occupied non-mine owned structure have never exceeded 33% of the current <br />permit level and typically are less than 20% of the permit level of 0.5 inches per second <br />(IPS) of ground vibration. All blast vibrations data measured at the closest off-site <br />structure during production blasting at the Cresson Project have been in compliance <br />with United States Bureau of Mines Report of Investigations 8507, Colorado <br />Department of Natural Resources Division of Reclamation, Mining and Safety and all <br />mining permits. Compliance with the blast vibration regulations precludes any <br />probability of damage to even the most sensitive structural elements in homes including <br />historically significant structures.” <br />With regards to blasting from underground operations, MMC concluded that the <br />blasting from underground operations, “is not expected to contribute an increase in <br />ground motion over what is already expected with current surface mining activities.” <br />MMC does recommend monitoring the vibrations caused by underground blasting <br />activities once underground mining activities commence. Newmont is committed to <br />performing such confirmation monitoring. <br />Lastly, Newmont will continue to conduct blast monitoring at several sites around the <br />affected lands boundary to demonstrate that ongoing blasting associated with mining <br />activities is not affecting structures, including utilities, located within 200 feet of the <br />affected lands boundary. <br /> <br />6. Drawing C-4. The response is not adequate. The revised drawing shows the requested <br />proposed underground workings shown in Drawings C-5a and C-5b. However, it raises <br />concerns that the “General Location of the Proposed Haul Road” shown near the southeast <br />area of the City of Cripple Creek is outside the affected area/permit boundary. Pursuant <br />to Rule 1.1(4) haul roads are included in the affected lands. Please clarify and revise <br />drawing C-4 as necessary. <br />RESPONSE: The Division is correct that a very small portion of the existing road <br />falls on adjacent property that is outside the proposed affected lands boundary. As part <br />of the planning process for the Chicago Tunnel underground activities, CC&V is <br />evaluating where to re-align the road as the existing road will need to be improved <br />before it can serve as a haul road. CC&V plans to place the haul road entirely on <br />CC&V owned property. We request that the Division issue its approval of Amendment <br />11 conditioned upon submitting designs for the proposed haul road in advance of <br />underground mining activities occurring at the Chicago Tunnel Mine Area. A revised <br />Drawing C-4 will be provided once a road alignment is identified.
