<br />2 <br /> <br />Application <br />4. Drawing C-1a. <br />b. This exhibit is apparently intended to show the owners of all structures within 200 feet <br />of the new affected area boundary (coincident with the permit boundary). The <br />Response is not adequate. Specifically the structure about 850 feet west of Grassy <br />Valley monitoring wells GVMW-22B & GVMW-22A along Beaver Valley Rd <br />(38o44’26.24”N, 105o 6’51.04”W) is not identified or discussed. <br /> <br />RESPONSE: The structure identified above and in the adequacy review comments dated <br />July 13, 2016 is located entirely within the current Amendment 10 boundary and is owned <br />by CC&V, t herefore it is not required to be identified on Drawing C-1a. CC&V apologizes <br />for not clarifying that in our original responses. Accordingly, CC&V has not revised <br />Drawing C-1a. <br /> <br />5. Drawing C-3. There are numerous utility alignments… The response is not adequate. <br />The drawing identifies utilities pursuant to Rule 6.4.3(b), but identifies only the owners <br />of the power lines (Black Hills Energy). Gas lines, water lines, phone lines and fiber <br />optic lines are also utilities. The revised drawing C-3 does not identify the owners of <br />the non- power line utilities. If CC&V does not own these additional utilities, <br />statements from utilities “that the mining and reclamation activities, as proposed, will <br />have "no negative effect" on their utility” will be required by the Division pursuant to <br />Rule 6.4.20(c)/Exhibit T. Please identify owners of ALL buildings and utilities within the <br />affected area and provide the statements from these utilities pursuant to C.R.S. 34-32- <br />115(4)(d) and Rule 6.4.20(c). <br /> <br />RESPONSE: Newmont has updated Drawing C-3 to show additional utilities and <br />ownership (See Attachment 1). <br />Rule 6.4.20 (Exhibit T) states that, “The Applicant shall provide information sufficient <br />to demonstrate that the stability of any structures located within two hundred (200) feet <br />of the operation or affected land will not be adversely affected. If the Office determines <br />that such information is inadequate to demonstrate that the operation will not adversely <br />affect the stability of any significant, valuable and permanent man-made structure, the <br />Applicant shall either: (a) provide a notarized agreement between the applicant and the <br />person(s) having an interest in the structure, that the applicant is to provide <br />compensation for any damage; or (b) where such an agreement cannot be reached, the <br />applicant shall provide an appropriate engineering evaluation that demonstrates that <br />such structure shall not be damaged by activities at the mining operation; or (c) where <br />such structure is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that mining and reclamation activities, as <br />proposed, will have “no negative effect” on their utility.” <br />CC&V is currently in discussions with Black Hills Energy to obtain a notarized letter
