Demonstration of Compliance Climax Molybdenum Company
With Regulation 41 Permit M-1977-493
which standards specific to the area have been adopted, therefore the Interim Narrative Standard
under the CBSG is applicable. DRMS Hard Rock Metal Mining Rule (HRMMR) 3.1.7(2)(c),
requires the use of the groundwater quality table values in the CBSG as a guide for establishing
numeric protection limits or permit conditions. In situations where ambient groundwater exceeds
groundwater table values, the rule requires establishing permit conditions to protect existing and
reasonably potential future uses against further lowering of groundwater quality.
The WQMP therefore establishes the criteria for(and demonstrates) compliance with Regulation
41 at Climax as of December 16, 2011 (date of TR-18 approval). Specifically, the WQMP states:
"Consistent with DRMS rules, Numeric Protection Levels (NPLs) will be established for POC
groundwater wells using the CBSG Table Value Standards as a guide with consideration given to
baseline data, where available. In instances where the existing groundwater quality exceeds a
CBSG table value, an alternate NPL is selected, based on the Interim Narrative Standard, to
protect against the further lowering of groundwater quality.
The following sections of this document demonstrate that groundwater data from POC wells were
collected in accordance with the approved WQMP. Consistent with the methodology approved
by DRMS as described in Section 5 of the WQMP, available monitoring data and other available
information were compared against the Interim Narrative Standard of the CBSG.
December 2016 2
