Storm Water Management Plan (SWMP), September 2012 <br />GCC Energy – King Coal & King II Mines <br />1 <br /> <br />SECTION 1: INTRODUCTION <br />1.1 Regulatory Background <br />In 1972, Congress passed the Federal Water Pollution Control Act (FWPCA) also <br />known as the Clean Water Act (CWA) to restore and maintain the quality of the nation’s <br />waterways. The ultimate goal was to make sure that rivers and streams remain clean for <br />people, animals, and drinking water. In 1987, the Water Quality Act (WQA) added <br />provisions to the CWA that allowed the Environmental Protection Agency (EPA) to <br />govern storm water discharges from construction sites and industrial activities. <br /> <br />The EPA grants the primary responsibility for issuing storm water discharge permits and <br />enforcing storm water regulations to states with qualifying programs. Colorado is such <br />a state and the storm water enforcement agency within the Colorado state government <br />is the Colorado Department of Public Health and the Environment (CDPHE). The <br />CDPHE authorizes storm water discharges under the Colorado Discharge Permit <br />System (CDPS) General Permit for Coal Mining Facilities (Permit No. COG-850000). <br />On June 18, 2008, CDPHE issued Certification No. COG-850001 to GCC Energy <br />authorizing storm water discharges from the King Coal Mine and King II Coal Mine. <br /> <br />The General Permit requires that the operator develop and implement a Storm Water <br />Management Plan (SWMP) for the portion of each facility covered by the Permit. The <br />SWMP must identify potential sources of pollution (including sediment), which may <br />reasonably be expected to affect the quality of storm water discharges associated with <br />the mining operation. In addition, the plan shall describe and ensure the implementation <br />of best management practices (BMPs), which will be used to reduce the pollutants in <br />storm water discharges, associated with mining activity. <br /> <br />This SWMP is a revision of the SWMP that was originally prepared on October 2005 <br />and subsequently was revised on September 9, 2008 to reflect a company name <br />change and change of responsible persons. This revision has been prepared to further <br />address operational changes at the King Coal Mine and to further incorporate the King II <br />Coal Mine. <br /> <br />1.2 Disclaimer <br />This SWMP is a living document and is intended to be modified and corrected by the <br />owner or contractor to comply with current state of Colorado requirements. SMA has <br />exercised care in preparing this report to the standards currently accepted by the <br />industry. However, SMA does not take responsibility for implementation, corrections, <br />filing applications or inspections, unless otherwise stated. The owner and contractor <br />accept responsibility for the document once signed or the STORMWATER PERMIT <br />APPLICATION is filed and takes full responsibility for their actions in accepting this <br />document, implementing BMP's and meeting all aspects of the Colorado requirements <br />for storm water Management.
