Mr. Gabe Racz Page 4 of 6 <br /> November 28, 2016 <br /> at times sufficient exchange potential exists to operate the exchange without injury to other <br /> water users. <br /> CONDITIONS OF APPROVAL <br /> This SWSP is hereby approved pursuant to § 37-92-308(4), C.R.S., and the following <br /> conditions; <br /> 1. This SWSP shall be valid through October 31, 2016, unless otherwise revoked or <br /> modified. Pursuant to§37-92-308(4)(b), C.R.S., "If an applicant requests renewal of a <br /> plan that would extend the plan past five years from the initial date of approval, the <br /> applicant shall demonstrate to the water judge in the applicable water division that the <br /> delay in obtaining a decree has been justifiable and that not being able to continue <br /> operating under a substitute water supply plan until a decree is entered will cause undue <br /> hardship to the applicant."This SWSP will not be approved for the 2016--2017 <br /> period unless we receive evidence from the court that the applicant has met this <br /> requirement. Should an additional SWSP be requested, the provisions of§ 37-92- <br /> 308(4), C.R.S., shall apply. The statutory fee of$300 will be required pursuant to § 37- <br /> 92-308(8), C.R.S. Any request for an additional SWSP must be submitted to this office <br /> by January 3, 2017. <br /> 2. Pumping from the underdrain pump back system must be measured in a manner <br /> acceptable to the Division Engineer. <br /> 3. Accounting of water in this plan, including surface areas of all zero-discharge areas <br /> within each drainage zone, identification of all ponds containing water and number of <br /> days each pond contains water, pumping from the pump back system, stream <br /> depletions, and replacement water deliveries must be provided to the Water <br /> Commissioner(Joshua.Kasper@state.co.us) and Division Engineer <br /> (Augmentation.Coordinator@state.co.us)on forms and at times acceptable to them. <br /> Said accounting must be received by the 1&of the month following the month being <br /> reported. The name, mailing address, and phone number of the contact person who is <br /> responsible for operation and accounting of this plan must be provided on the <br /> accounting forms. The Division Engineer may require that any or all measuring devices <br /> associated with the pump back system and replacement deliveries be verified for <br /> accuracy by an approved meter tester. <br /> 4. Any exchanges that may be necessary for the utilization of the above-mentioned <br /> replacement sources must be approved in advance by the Water Commissioner. The <br /> Applicant is required to obtain the Water Commissioner's approval on a daily basis or <br /> other interval as required by the Water Commissioner. The proposed exchanges are <br /> limited to operating only at times there is a continuous live stream between the <br /> exchange from and exchange to points and at times sufficient exchange potential exists <br /> to operate the exchange without injury to other water users. <br /> 5. To the extent that a portion of the UAWCD replacement water comes from Twin Lakes <br /> Reservoir, that portion will be released to the control of the Division Engineer at the <br /> beginning of the Plan Year and placed in the State Engineer's Augmentation Account in <br /> Twin Lakes for release by CC&V and UAWCD in consultation with the Division <br /> Engineer. The full yield of the Twin Lakes shares will be released for the benefit of this <br />
