Mr. Gabe Racz Page 3 of 6 <br /> November 28, 2016 <br /> City of Victor water rights <br /> CC&V has an agreement with the City of Victor that provides up to 1,300 acre-feet per <br /> year of augmentation water, The individual water rights are listed in the application and the <br /> court case. <br /> City of Colorado Springs <br /> CC&V has an agreement with the City of Colorado Springs to purchase fully consumable <br /> raw water. This water is considered to be a backup source, and will be released as needed and <br /> if available. <br /> Pueblo Board of Water Works <br /> CC&V has a long-term lease with PBWW to furnish 400 acre-feet of fully consumable <br /> water each year. This water will be stored in Wright's Reservoir via exchange or contract trade <br /> and released as needed. As of September 2015,419 acre-feet of water for this purpose were <br /> stored in Wright's Reservoir. Pueblo is also holding 317.21 acre-feet available for additional <br /> delivery through April 30, 2016, when a new annual 400 acre-feet will become available. Transit <br /> losses for the 13 mile reach from Wright's Reservoir outlet to the confluence of Fourmile Creek <br /> and Cripple Creek will be assessed by the Water Commissioner and Division Engineer. <br /> CC&V exchange water rights <br /> CC&V has applied for conditional water rights and exchange rights in Case No. 98CW115 <br /> (pending) and absolute water rights and exchange rights as a co-applicant with the City of Victor <br /> in Case No. 1 OCW98 (decreed on January 2, 2015). Any water adjudicated in those cases may <br /> be used for replacement. <br /> Upper Arkansas Water Conservancy District(UAWCD) <br /> CC&V leased 100 acre-feet of fully consumable water from UAWCD in 2013, and approximately <br /> 11 acre-feet are stored in Pueblo Reservoir and other reservoirs under the Town of Victor's <br /> account. This is available for delivery by exchange or contract trade. <br /> Several of the sediment detention ponds are located within close proximity or outside of <br /> the northerly diatreme boundary in the West Beaver creek drainage basin via Grassy Creek. <br /> Therefore, replacement supplies in the Beaver Creek Basin are required as a part of the subject <br /> SWSP. <br /> Any releases must include transit losses and be coordinated with the Division 2 office <br /> and the Water Commissioner. <br /> Any exchanges that may be necessary for the utilization of the above-mentioned <br /> replacement sources must be approved in advance by the Water Commissioner. The Applicant <br /> is required to obtain the Water Commissioner's approval on a daily basis or other interval as <br /> required by the Water Commissioner.
