Costilla St. <br />Colorado Springs, CO 80903 <br /> <br />Re: Daniels Sand Pit 2, Permit No. M-1973-007SG; <br /> Letter of Concerns, Technical Revision (TR-05) <br /> <br />Dear Mr. Schnabel: <br /> <br />On November 7, 2016 the Division of Reclamation, Mining and Safety (Division) received your <br />request for a Technical Revision, addressing the following: <br /> Construct a new wash fines pond. <br />The Division believes this modification should be resubmitted as an amendment application. I <br />informed Mr. Brandon Heser of our position on Monday, November 23, 2016 via telephone and <br />discussed the specifics with Mr. Bruce Humphries during a telephone call this morning. Mr. <br />Humphries requested an adequacy review today. I informed him we could not get a formal adequacy <br />letter completed and mailed today, but that in the interest of time, I could provide a list of concerns <br />that will need to be addressed in detail during the adequacy review process. The following summarizes <br />the Division’s current areas of concern: <br /> Potential impact the hydrologic balance, primarily from a groundwater quality <br />perspective as the pond would potentially act as an infiltration gallery/recharge pond <br />directly over the PCE plume from Schlage Lock to the east and being treated within <br />the permit boundary as outlined in TR-03, <br /> Formal notice to both CDPHE and Schlage Lock with respect to impacts on the <br />aforementioned Schlage Lock remediation program, <br /> Formal notice to DWR- Dam Safety with respect to potential impacts to S. Academy <br />Blvd should the embankment fail (possibly due to earthquake impact resulting in <br />liquefaction of the embankment and the deposited fines within the pond area), <br /> Formal notice to adjacent property and structures owners within 200 feet of the <br />proposed facility,
