' M-2016-030,Response to Second Adequacy Letter <br /> 17 November 2016 <br /> Page 2 of 3 <br /> and maintained by the City of Fort Lupton. The City of Fort Lupton and all other owners of record <br /> in this area were provided notice,with receipts included in the Applicant's November 8 letter. <br /> e. By virtue of the referenced 1975 right-of-way deed,the owner of record for Weld Co. Rec. No. <br /> 1678646 is the Panhandle Eastern Pipeline Company. The 1975 deed provides no address <br /> information,and the Secretary of State's website indicates no current registration for this <br /> business to operate in Colorado. Historical records available by online search indicate that <br /> Anadarko's assets were, in part, spun off from the assets of the Panhandle Eastern Pipeline <br /> Company at some time between 1975 and the present day, most likely in approximately 1986.1 <br /> When the Applicant called for utility locates,the pipeline markers corresponding to the apparent <br /> alignment at issue were identified as belonging to Kerr-McGee/Anadarko Petroleum Company. <br /> The Applicant accordingly sent notice to a Denver address and a Texas address associated with <br /> Anadarko's acquired pipeline assets. The receipts of this mailing were copied in the Applicant's <br /> November 8 adequacy response, reflecting that the Denver letter was mailed (and received)after <br /> the Texas letter was returned. For the record,Anadarko has received constructive notice of the <br /> operation, as evidenced by its prior submittal of a letter to the Division concerning the M-2016- <br /> 030 application. <br /> 2. Exhibit C-1 has been revised to label the pipeline easement at the northwest corner of the Affected <br /> Land. It is not necessary to modify Exhibit C-1 to locate features associated with Weld County Road 6, <br /> which is 1300 feet south of the Affected Land. The Exhibit has also been corrected to show that Weld <br /> County Road 8,adjacent to the access drive, is owned by the City of Fort Lupton. <br /> 3. Exhibit C-1 is revised to indicate that Brannan Sand and Gravel Company, L.L.C., is the owner of the <br /> proposed mine site. <br /> 4. The Division's estimate of reclamation costs is acknowledged. <br /> 5. A copy of this Second Adequacy Response letter,along with its attachments,was placed on file in the <br /> office of the Weld County Clerk and Recorder. A receipt is attached. <br /> 6. As correctly articulated by the Division,the Applicant asserts compliance with Rule 6.4.19 by virtue of <br /> its offer of an agreement to the owner of each potentially affected significant,valuable and <br /> permanent man-made structure within 200 feet of the Affected Land. The Division's November 15 <br /> letter identifies structure owners for which compliance with Rule 6.4.19 is not necessary or has <br /> already been obtained. <br /> a. Hunt Brothers Properties does not own any significant, permanent, man-made structure <br /> within 200 feet of the Affected Land. This owner's property lies entirely on the west side of <br /> the Union Pacific Railroad,at least 400 feet from the Affected Land. <br /> b.
