M-2016-030,Response to Adequacy Letter <br /> 8 November 2016 <br /> Page 9 of 10 <br /> Please find attached proof that structure owners were contacted, consisting of sender receipts and USPS <br /> delivery receipts/returned envelopes for structure agreements sent via United States Post Office Certified <br /> Mail (Attachment 12). <br /> Also attached are executed agreements with United Power, Verle Schoen, and the Villano Brothers Family <br /> Investments. The Applicant will transmit any additional agreements as they become available (e.g., Sprint is <br /> currently negotiating details with the Applicant). <br /> Each structure owner received an introductory letter, identifying the owner's structure or structures within <br /> 200 feet of mine slopes, and an executable form agreement. The Applicant/Operator did not research <br /> abandoned, derelict, and other non-permanent structures, many of these being appurtenant to the subject <br /> property and owned and controlled by the Applicant/Operator (e.g., old power poles, interior fencing, <br /> collapsed headgates in dry ditches). <br /> The attached slope stability study demonstrates that mine-to slopes will be stable at 1.5:1 horizontal-to- <br /> vertical ratio at any location on the permitted property. The operator will adhere to these safety limits in the <br /> vicinity of potentially affected structures. <br /> The Valley's Edge Resource is a unique project. Brannan Sand and Gravel believes that it embodies the best <br /> purposes of reclamation. The project will support the availability of construction materials in Colorado, <br /> consistent with state policy. The mining and reclamation project itself renews the productivity of property <br /> that has been economically idle for a decade. Through the mining and reclamation process, the former <br /> feedlot will be cleaned up and prepared for users needing small, mid-size or large industrial lots, consistent <br /> with local land use plans. <br /> We appreciate the Division's technical review of the M-2016-030 and welcome any additional questions or <br /> comments stemming from this adequacy response.
