P C)
rammomTransit Mix Concrete Co.
RPM,Inc.
(c) Compliance with applicable federal and Colorado dredge and
fill requirements:
This requirement is not applicable to the pond's construction activity since no wetlands will be
impacted.
(d) Remove temporary or large siltation structures from drainage
ways after disturbed area are revegetated and stabilized, if required by the Reclamation
Plan:
This requirement is not applicable to the pond since the structure will not be placed in a drainage
way.
(2) Earthen dams, if necessary to impound water, may be constructed if
the formation of such impoundments will not damage adjoining property or conflict with
water pollution laws, rules or regulations of the federal government, the State of Colorado or with
any local government pollution ordinances:
An earthen embankment is proposed for the site as part of the mining and reclamation plan. This
will be an incised wash fines disposal pond, with a retention embankment on one side, within the
mined out pit area. The proposed embankment out-slope is approximately 30 feet in height and
categorized as a non-jurisdictional structure by the Division of Water Resources. (Please see
Exhibit 2) There is no outlet from the structure. Slurry is delivered to the pond and the sand
settles out. The water is then returned to the Company's processing plant for re-use. Other than
the adjoining slopes, no storm water runoff is directed to the waste disposal pond.
6.4.4 Mining Plan:
(a) Not applicable
(b) Not applicable
(c) All water diversions and impoundments; and
The only impoundment that is part of this revision is the proposed new waste fines disposal
pond.
(d) Not applicable
9
