Proposed Uses: Weld County will use water from the Geisert Reservoir for <br /> augmentation, agricultural, industrial, mineral resource development, mining <br /> operations and construction of public works projects including operating air <br /> emissions control devices; controlling fugitive particulate emissions; washing and <br /> processing sand, gravel, and aggregate; washing equipment; replacement of <br /> evaporative losses of water from mined materials stockpiled or removed from the <br /> site; irrigating or landscaping, reclamation of construction sites for public <br /> facilities, fire suppression, and emergency response. Central will use water from <br /> the Geisert Reservoir for augmentation, agricultural, industrial, mineral resource <br /> development, and irrigation. The water may be used by Weld County and Central <br /> within their respective boundaries. Augmentation use will be in accordance with <br /> paragraph 9.13 below. <br /> 9.9. Surface Area at High Water Line:43.5 acres <br /> 9.10. Capacity of Reservoir: Central claims the right to fill the reservoir to a capacity <br /> of 2,180 acre-feet, conditional, with the right to one refill in the same amount. <br /> Weld County claims the right to fill the reservoir to a capacity of 20 acre-feet, <br /> conditional, with the right to one refill in the same amount. Collectively, Co- <br /> Applicants claim the right to fill the reservoir to a total capacity of 2,200 acre feet, <br /> conditional, and claim the right to one refill of the Reservoir up to an additional <br /> 2,200 acre feet when the same is in priority. <br /> 9.11. Description of Project: Water will be diverted from the Cache la Poudre River <br /> and stored in Geisert Reservoir in priority for application to the beneficial uses <br /> listed herein. Geisert Reservoir has been sealed with a bentonite slurry wall <br /> installed around the perimeter of the Reservoir such that it will not intercept <br /> ground water and that liner has been approved by the Colorado State Engineer by <br /> letter dated August 3, 2012. <br /> 9.12. Measurement and Accounting. The water diverted, stored and released from <br /> the Geisert Reservoir shall be accounted for by Central. A stage-area-capacity <br /> relationship curve for Geisert Reservoir has been developed and is attached hereto <br /> as Exhibit B. Diversions into and releases from Geisert Reservoir shall be <br /> measured on a daily basis with measuring devices equipped with continuous <br /> recorders. <br /> 9.13. Use in Previously Decreed Augmentation Plans. The water diverted under this <br /> right may be used in Central and the Well Augmentation Subdistrict of the <br /> Central Colorado Water Conservancy District's augmentation plans decreed in <br /> Case No. 02CW335 and 03CW99, and in Weld County's augmentation plans <br /> decreed in Case Nos. 12CW304, 06CW274, 12CW109, 04CW359, and 09CW100 <br /> once the water right decreed herein has been incorporated as an augmentation <br /> supply in those decrees pursuant to their respective terms. <br />
