J. Beck
Page 3
1 November 2016
13. Section 2.03.10 — Other Licenses and Permits
The required information was not submitted.
14. Section 2.03.11— Location of Public Office for Filing of Application
The required information was not submitted.
15. Section 2.03.12 (and 2.07.3(2)) — Proposed Public Notice
The required information was not submitted.
16. Section 2.04.3(1)-(4) — Site Description and Land Use
The required information was not submitted. DRMS recommendeds you review the Conversion
application submitted for DRMS File No. C-1976-014 dated September 24, 1976 and received by the
Division on September 23, 1976, to obtain information about the previously conducted mining activity at
the site in order to assist with complying with subsection (3) of this Rule. However, it should be noted
that you indicated that the future proposed mining activity will be conducted in Section 7 of T31 S, R65W.
The current affected area from the former Healey Pit (C-1976-014) is within Section 8, of T31S, R65W.
If the new proposed permit area will not encompass the former mine operation or any other previously
mined land, subsection (3) of the rule may not apply
17. Section 2.04.4(1) — Cultural and Historic Resources
The required information was not submitted. The coal regulations cited above stipulate conducting a
survey and compiling on inventory of any cultural and historic resources or sites.
Prior to initiating any studies to comply with this Rule, more information regarding the proposed
operation will need to be submitted. The Division will need to know exactly where the proposed permit
area will be and where the mining operation and associated facilities exist within this area.
18. Section 2.04.5(1) — General Surface Water and Groundwater Hydrology
The required information and maps were not submitted. The current rules require the following:
a) a description of the regional geology in reference to the permit area,
b) a map in accordance with 2.10 providing regional hydrological features and drainage areas,
c) and an adequate characterization of surface and groundwater quality and quantity for this section.
19. Section 2.05.6(1) and (2) — Geology
The required information was not submitted. No relevant information was found in the former permit.
20. Section 2.04.7(1) — Groundwater Information
The required information was not submitted. No hydrologic studies have been performed. The former
mine permit C-1976-014 did not expect to encounter groundwater. Based on the fact that one of the
former pits is currently holding groundwater, the previous expectation does not appear to be correct.
