Per subsections (2) and (3) of this Rule, prior to the <br />applicant initiating any studies to comply with this Rule, more information regarding the proposed <br />operation will need to be submitted. The Division will need to know exactly where the proposed permit <br />area will be and where the mining operation will occur within this area. Based on this information, the <br />Division will then consult with the appropriate State and Federal fish and wildlife management, <br />conservation or land management agencies to determine the level of detail and the areas possibly needed <br />for further study. <br />Section 2.04.12 — Prime Farmland Investigation <br />The required information was not submitted. <br />Section 2.05.3(5) — Operation Plan — Permit Area — Topsoil <br />The required information was not submitted. There is some topsoil salvage and replacement information <br />contained in the permit file for the original Healey Pit (C-1976-014), however the new permit area is <br />indicated to be much larger and possibly not within the original Healey Pit area. Regardless, for the new <br />proposed permit area, the applicant must submit the information required by Rule 2.04.9. Based on this <br />information, the applicant will need to submit information to comply with Rule 2.05.3(5). <br />Section 2.05.3(6) — Operation Plan — Overburden <br />The required information was not submitted. <br />Section 2.05.6(2) — Mitigation of the Impacts of Mining Operations — Fish and Wildlife Plan <br />The required information was not submitted. Once the applicant has submitted the information required <br />by Rule 2.04.11 and the appropriate wildlife consultations have occurred with the appropriate State and <br />Federal wildlife management agencies, the applicant will need to develop a wildlife mitigation plan in <br />accordance with Rule 2.05.6(2). There is very little wildlife information contained in the C-1976-014 <br />permit file and the original wildlife consultation letters will likely no longer be valid. <br />Section 2.06.6 — Special Categories of Mining — Prime Farmlands (1.04(95)) <br />The required information was not submitted. The applicant will need to submit the required information <br />and conduct the necessary Prime Farmland investigations in accordance with Rule 2.04.12. Based on this <br />information the applicant may need to submit information to comply with Rule 2.06.6 if the applicant <br />intends to conduct surface coal mining activities on prime farmlands historically used for cropland. <br />
