Based on the brief <br />paragraph submitted for the application, it appears it is the applicants desire to re-initiate activity at the <br />Healey Pit, former DRMS File No. C-1976-014. I have reviewed the file regarding the previous mining <br />operation and the permit application documents. Overall, the former permit documents do not comply <br />with the current standards of the Regulations of the Colorado Mine Land Reclamation Board for Coal <br />Mining that went into effect on August 30, 1980 with the most recent revision to the Rules dated <br />September 14, 2005. The following is a list of rules I was specifically requested to review. The permit <br />applicant will need to review the following rules and submit the information required. <br />Section 2.04.3(1)-(4) — Site Description and Land Use <br />The required information was not submitted. It is recommended that the applicant review the conversion <br />application submitted for DRMS File No. C-1976-014 dated September 24, 1976 and received by the <br />Division on September 23, 1976, to obtain information about the previously conducted mining activity at <br />the site in order to assist with complying with subsection (3) of this Rule. However, it should be noted <br />that the applicant indicated that the fixture proposed mining activity will be conducted in Section 7 of <br />T31S, R65W. The current affected area from the former Healey Pit (C-1976-014) is within Section 8, of <br />T31 S, R65W. If the new proposed permit area will not encompass the former mine operation or any other <br />previously mined land, subsection (3) of the rule may not apply. <br />Section 2.04.4(1) — Cultural and Historic Resources <br />The required information was not submitted. <br />Section 2.04.9 — Soils Resource Information <br />The required information was not submitted. Some Soil Conservation Service Soils information was <br />included in the original application for the C-1976-014 application and the conversion application.
