CONCLUSIONS OF LAW <br /> 7. The Board has jurisdiction over this matter pursuant to the Colorado Land <br /> Reclamation Act for the Extraction of Construction Materials,Article 32.5 of Title 34, C.R.S. <br /> (2016). <br /> 8. Construction Materials Rule 4.2(2).requires the Board,to hold a hearing,in <br /> accordance with the notification and comment provisions of Construction Materials Rule <br /> 1.6,to reconsider the previous approval, if a financial warranty for an approved application <br /> is not received within one calendar year of the approval for a new permit <br /> 9.
