BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF RECONSIDERATION OF APPROVAL OF PERMIT FOR <br /> CROSSFIRE AGGREGATE SERVICES, LLC AFTER ONE CALENDAR YEAR, <br /> File No. M-2015-001 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> September 28, 2016, in Denver, Colorado as a consent agenda item for <br /> reconsideration of a permit approval after 365 days for Crossfire Aggregate <br /> Services, LLC ("Operator"), file number M-2015-001. <br /> The Board, having considered the materials presented with this consent <br /> agenda item and being otherwise fully informed of the facts in the matter, enters <br /> the following: <br /> FINDINGS OF FACT <br /> 1. On July 6, 2015, the Division of Reclamation, Mining and Safety <br /> ("Division") approved the application for a new 112(c) permit located in Section 1, <br /> Township 32 North, Range 10 West, loth Principal Meridian in La Plata County. <br /> The site is known as Crossfire Bonds Gravel Pit. <br /> 2. The Division had the authority to approve the application pursuant to <br /> Mineral Rules and Regulations of the Board for the Extraction of Construction <br /> Materials ("Construction Materials Rules"), 2 CCR 407-4, Rule 1.4.8. <br /> 3. The Operator failed to post the financial warranty within 365 days of <br /> the approval of the application. <br /> 4. The Operator complied with the notice and comment provisions of <br /> Construction Materials Rule 1.6, as required by Construction Materials Rule 4.1(2), <br /> prior to the Board's reconsideration of the previous application approval. No <br /> comments or objections were received. <br /> 5. The Operator has submitted the required performance warranty and <br /> financial warranty in the amount of$225,851.57. <br /> 6. On September 19, 2016, Operator admitted the failure to post the <br /> require financial warranty and agreed to the Division's recommendations to <br /> the Board. <br />
