I am the Environmental Protection Specialist for Pueblo County and reviewed the permit application for the <br /> Pueblo County Aggregate Project, file no. M-2016-009, submitted by Fremont Paving & Redi-mix, Inc. I have attached <br /> the Division's Recommendation to Approve letter and the Rationale document regarding the site. <br /> Unfortunately, your objection email is considered late because the public comment period for the application closed on <br /> August 4, 2016. However, many of your concerns are addressed in the rationale. <br /> Please be assured, the application met the applicable wildlife requirements pursuant to C.R.S 34-32.5-102 and C.R.S. <br /> 34-32.5-116(4)(m)of the Colorado Land Reclamation Act for the Extraction of Construction Materials and Rule 3.1.8, and <br /> Rule 6.4.8 of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br /> Construction Materials. This mining lease <br /> will put operations directly in the path of these birds. The International Migratory Bird Treaty Act protects migrating birds. <br /> Threatened species, like Burrowing Owl, are found in this area. Osprey and Golden Eagle are visitors. <br /> Human disturbance- noise, truck exhaust, blowing dirt, trafiic(200 trucks, 100+ loads/day)-will most certainly disturb these <br /> birds, not to mention private landowners. <br /> Quiet, isolated areas feed the human spirit, an intangible that cannot be dismissed.
