Response is adequate. <br />b. This exhibit is apparently intended to show the owners of all structures within 200 feet <br />of the new affected area boundary (coincident with the permit boundary). The response <br />is not adequate. Specifically, the structure about 850 feet west of Grassy Valley <br />monitoring wells GVMW-22B & GVMW-22A along Beaver Valley Rd <br />(38°44'26.24"N, 105° 6'51.04"W) is not identified or discussed in the response. <br />c. TR-69 and AR-01 / new radio tower location. Response is adequate. <br />d. R0055878 CC&V Pavilions. Response is adequate. <br />5. Drawing C-3. There are numerous utility alignments… The response is not adequate. <br />The drawing identifies utilities pursuant to Rule 6.4.3(b), but identifies only the owners of <br />the power lines (Black Hills Energy). Gas lines, water lines, phone lines and fiber optic <br />lines are also utilities. The revised drawing C-3 does not identify the owners of the non- <br />power line utilities. If CC&V does not own these additional utilities, statements from <br />utilities “that the mining and reclamation activities, as proposed, will have "no negative <br />effect" on their utility” will be required by the Division pursuant to Rule 6.4.20(c)/Exhibit <br />T. Please identify owners of ALL buildings and utilities within the affected area and provide <br />the statements from these utilities pursuant to C.R.S. 34-32-115(4)(d) and Rule 6.4.20(c). <br />6. Drawing C-4. The response is not adequate. The revised drawing shows the requested <br />proposed underground workings shown in Drawings C-5a and C-5b. However, it raises <br />concerns that the “General Location of the Proposed Haul Road” shown near the southeast <br />area of the City of Cripple Creek is outside the affected area/permit boundary. Pursuant to <br />Rule 1.1(4) haul roads are included in the affected lands. Please clarify and revise drawing <br />C-4 as necessary. <br />7. Drawing C-4a. Response is adequate. <br />8.
