Permit#M-1979-045 <br /> On behalf of our client Lakewood Brick and Tile Co., I am submitting the following information <br /> as a response to your Second Adequacy Review letter dated September 27, 2016. 1 have included your <br /> k11 question and my response in the order presented so we have all of the information in one file. <br /> 1. The Operator is proposing to eliminate surface water runoff which accumulates in the pit by pumping and <br /> discharging the water onto the affected lands. The Operator has stated a stormwater discharge permit will be <br /> required for this activity. Please demonstrate a discharge permit is not required through the Colorado Water <br /> Quality Control Division or commit to obtaining a discharge permit prior to initiating pumping activities. <br /> This plan does not involve discharging stormwater from the Permit area. The <br /> plan we will use is to install a spray system that will jointly serve M-1979- <br /> 045 and M-1983-113 that will allow the water trapped in the mined area to be <br /> sprayed on the undisturbed vegetation areas around the mine so it returns to <br /> the system naturally. This method has been acceptable since 1994 by the <br /> CDPHE to avoid having to get a direct discharge permit for removing the <br /> stormwater that collected in the clay mine. However, if a discharge permit <br /> is needed, the mine is covered by CDPHE Permit NO. COG-501547 and an up-to- <br /> date Stormwater Management Plan. <br /> 2. The Reclamation Plan Addendum states the concrete batch plant has a separate permit from Jefferson County <br /> and may remain on site following the completion of reclamation. The Division would like to remind the Operator <br /> the current post-mining land use for the site is wildlife habitat. A change in the post-mining land use would <br /> need to be approved through an Amendment in order for the concrete batch plant to remain after the life of the <br /> mine. <br />
