Scott Wanstedt of Blue Mountain Energy, Inc.(BME) <br />was present for the inspection. The weather was clear with a temperature of 80 degrees Farenheight. The ground <br />conditions were mostly dry with some areas damp from precipitation events the weekend prior to the inspection. <br />AVAILABILITY OF RECORDS – Rule 5.02.4(1): <br /> The records for the Deserado Mine are kept at the main mine office with Scott Wanstedt. The records are <br />up to date and in good condition. For more details, please see the Availability of Records form at the end of this <br />report. <br /> <br />BACKFILL and GRADING – Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> During the inspection backfilling and grading of the 11L vent shaft was occurring. The shaft had been <br />sealed prior to the inspection by plugging the bottom 20 feet of the shaft with concrete, filling the shaft with soil, <br />and then plugging the top 10 feet of the shaft with concrete (Photo 1). A dozer was working on pushing subsoil <br />back onto the pad (Photo 2). When finished, the pad will be returned to approximate original contour, topsoil will <br />be placed back on the site and then reseeded. <br /> <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br /> The Facilities Area ponds DP-1, PP-1 and PP-2 were inspected. DP-1 was impounding water at the time <br />of the inspection. The water had not reached the primary spillway. Water from DP-1 was being pumped out to <br />use in the processing facility. The embankments were stable and well vegetated. No indications of erosion were
