(Tri-State)received your <br /> adequacy letter dated September 15,2016 for technical revision 02(TR-02). Tri-State is <br /> submitting this adequacy response on behalf of the Colowyo Mine. Colowyo operates the <br /> Neilson Pit under Permit No.M-2007-026,and Tri-State is the parent company to Axial Basin <br /> Coal Company,which is the general partner to Colowyo Coal Company L.P. (Colowyo). <br /> 1. Does the estimated 80,000 cu.yds. of material to be grade include the 15,000 cu.yds. <br /> of blasted material? <br /> Response: The 80,000 cubic yards of material to be graded does include the 15,000 <br /> cubic yards of material to be blasted. <br /> 2. How many acres will be disturbed through the grading process and require seeding? <br /> Response: There will not be any new disturbance associated with grading or seeding <br /> process. The total acreage that will be reclaimed is 9.5 acres. This is also expressed <br /> in Section 6.3.4 Exhibit D—Reclamation Plan within the permit. <br /> 3. The Division acknowledges that the site has an apparent lack of topsoil. Please <br /> indicate how you will overcome this. <br /> Response: The Division's comment needs to be further clarified as it is partially <br /> correct. The Neilson Pit did not have a lack of topsoil pre-mine; it did not have yny <br /> topsoil prior mining occurring. As noted in Section 3.3.3 Exhibit C—Mining Plan of <br /> the permit,mining has and does occur directly into a rock outcrop. Further,please <br /> see the response to Item 3a. <br /> a.
