It is <br /> the Division's understanding that the Providence Mine is not being incorporated into <br /> the Cresson Project permit(M-1980-244)with this amendment, nor does the proposed <br /> permit boundary include the Providence Mine. Please remove all permits not associated <br /> with the Cresson Project and areas proposed to be annexed by AM-11/AM-11.1. <br /> RESPONSE. The Division is correct that the Providence Mine is not included as part <br /> ofAmendment I1. Exhibit Mhas been updated to only show permits related to M-1980- <br /> 244 and is included in Attachment 2. <br /> 6.4.15 EXHIBIT O—Owner(s)of Record of Affected Land (Surface Area)and Owners of <br /> Substance to be Mined <br /> 11. In regards to Comment 3b above: <br /> • This exhibit is required to show "all immediately adjoining surface owners of <br /> record" [Ref. Rule 6.4.3(a)]. The map does not depict which individual "Private <br /> Third Party" owns each parcel. Drawing C-1 in AM-10 placed ID numbers on <br /> each parcel to correspond to a table in Exhibit O,Owners of Record. The addition <br /> of Teller Co. Assessor account numbers to this map and referencing Exhibit O <br /> would suffice in meeting this requirement. Please provide a map showing owners <br /> of record, inclusion of the"Teller County Account No." on Drawing C-1 would allow <br /> the Division to assess whether or not all owners of record of the affected land have been <br /> identified. Please revise Drawing C-1. <br /> RESPONSE.Drawing C-1 from the Amended Amendment 11 application has been <br /> revised to include the Teller County Account number for each parcel(See Attachment 1) <br /> to comply with Rule 6.4.3(a). We are still confused by DRMS's reference to Exhibit O <br /> for adjacent land owners. Section 6.4.15 defines Exhibit O as a complete list of owners <br /> of affected lands (Surface Area) and Owners of substances to be mined. It does not <br /> include a list of adjacent property owners and therefore cannot be used to cross <br /> reference the information required by 6.4.3(a). As noted in our responses above, CC&V <br /> has developed a new Drawing C-1 b, which shows parcel IDs of owners of affected lands <br /> (Surface Area) and owners of substance to be mined that can be used to cross referenced <br /> the information contained in Exhibit O. <br /> 6.4.20 EXHIBIT T—Permanent Man-Made Structures <br /> 12.
