4. will commit to operational maintenance of the check dams, including insuring that the channel
remains open and sediment loading kept to a minimum.
5. Teller County understands that Phase I construction modification reflects the conditions currently
at the site and that deferring Phase II construction will insure liner integrity is maintained by
minimizing exposure to ultraviolet rays and weather prior to being covered and loaded with
material. It is also understood that in the interim, the constructed diversion channel, proposed
check dams and operations and maintenance checks should prove protective against erosion and
slowing storm water according to CC&Vs plans.
6. Teller County acknowledges that the proposed facilities and storm water measures are all on land
owned by CC&V and are inside the Amendment 10 boundary and that no additional burden of
any kind will be placed on Teller County as a result of TR-82.
7. Teller County recognizes that State and Federal agencies have programs in place to permit,
inspect, and enforce requirements at mining operations to assure protection of the environmental
resources associated with such mining operations. As such, if DBMS approves this TR as
outlined,to include a modification to the Phase I Liner completion location,a deferment of the
construction of Phase II and is satisfied with the storm water controls in existence and as
proposed,Teller County will have no objections to TR-82. If, however, DRMS disapproves this
request, we would request you contact us.
If you have any questions, please contact me at(719)686-5414 or email williamsdoco.teller.co.us.
Respe5s Ifni ly'
Dan W' iams,Teller County Planner
Cc: Lynda Morgan, CDSD Director
Tim Cazier, DRMS
