Teller County understands that Phase I construction modification reflects the conditions currently <br /> at the site and that deferring Phase II construction will insure liner integrity is maintained by <br /> minimizing exposure to ultraviolet rays and weather prior to being covered and loaded with <br /> material. It is also understood that in the interim,the constructed diversion channel, proposed <br /> check dams and operations and maintenance checks should prove protective against erosion and <br /> slowing storm water according to CC&Vs plans. <br /> 6. Teller County acknowledges that the proposed facilities and storm water measures are all on land <br /> owned by CC&V and are inside the Amendment 10 boundary and that no additional burden of <br /> any kind will be placed on Teller County as a result of TR-82. <br /> 7. Teller County recognizes that State and Federal agencies have programs in place to permit, <br /> inspect,and enforce requirements at mining operations to assure protection of the environmental <br /> resources associated with such mining operations.As such, if DBMS approves this TR as <br /> outlined,to include a modification to the Phase I Liner completion location,a deferment of the <br /> construction of Phase II and is satisfied with the storm water controls in existence and as <br /> proposed,Teller County will have no objections to TR-82.
