The flume still needs to be repaired. The embankment was <br />stable and vegetated. The primary and emergency spillway was clear and functional. <br /> <br />Section 2.05 of the permit discusses several locations were a variance to the requirement that no land within 100 <br />feet of a perennial stream, an intermittent stream or an ephemeral stream with a drainage area greater than one <br />square mile, shall be disturbed by surface and underground coal mining operations. These areas were observed <br />during this inspection. <br /> <br />An area of land within 100 feet of Foidel Creek was impacted by the widening of the truck loading area near the <br />stoker coal handling system. The road embankment was observed during this inspection and overall it appears <br />stable. TC should monitor where Foidel Creek bends close to the road embankment as this area is very steep. <br /> <br /> Figure 1. Truck Loadout Haul Road Embankment Near Foidel Creek. <br />A waterline crosses Fish Creek south of the 6MN Reservoir. The Division observed where the pipeline crosses the <br />creek and where the pipeline corridor intersects the 100 foot stream buffer zone for Fish Creek. The pipeline <br />corridor is well vegetated. Som e noxious weeds have established but otherwise the area appears stable. Cattle use <br />of this area is heavy, cattle traffic was observed near where the pipeline crosses Fish Creek. Overall these areas <br />appear stable and no apparent mining related damage was observed on Fish Creek at these locations.
