Relevant excerpts from the permits are summarized below. (Note <br /> that the Al Pit is frequently referred to as the 83rd Joint Venture in permit applications and <br /> - approvals). General guidance regarding mined land reclamation developed by the Colorado <br /> Mined Land Reclamation Board are also provided for reference: <br /> Al Pit-Permit Language <br /> Permit Application to DRMS, 83rd Joint Venture (June 4, 1992) (Regular Operation 112 <br /> Reclamation Permit). <br /> • Grading will be done to provide stabilized shorelines around the lakes(§Grading). <br /> • The grading will be done to control erosion (§Grading). <br /> • All slopes created by the mining operation will be no greater than 3H:1 V(§Grading). <br /> • This mining operation will not adversely affect the stability of any significant, valuable <br /> and permanent man-made structure(s) located within two hundred (200) feet of the <br /> affected lands (§Notice to Commenters/Objectors). <br /> DRMS Permit Approved with Conditions (October 23, 1992) (Regular Operation 112 <br /> Reclamation Permit, 83'd Joint Venture; Letter) <br /> • Permit#M-1992-069. <br /> • Stipulation No. 03: Operator cannot disturb, pending a stability analysis or approval by <br /> owner, within 200 feet of man-made structures (Bellweather Oil and Gas, Boyd-Freeman <br /> Ditch, overhead utilities, Colorado Southern Rail Road F). <br /> Weld County Land Use Permit—Special Review Permit <br /> • Approved October 21, 1992. <br /> • A Flood Hazard Development Permit shall be submitted and approved by the Department <br /> of Planning Services (p. 3). <br /> • The Special Use Permit is located in the 100-year floodplain. The Special Review Permit <br /> development standards address the overlay district requirements. No other overlay <br /> districts affect the site (p. 133). <br /> • The application complies with the County Flood Hazard Overlay District Regulations (p. <br /> 63). <br />
