Relevant excerpts from the permits are summarized below. (Note
that the Al Pit is frequently referred to as the 83rd Joint Venture in permit applications and
- approvals). General guidance regarding mined land reclamation developed by the Colorado
Mined Land Reclamation Board are also provided for reference:
Al Pit-Permit Language
Permit Application to DRMS, 83rd Joint Venture (June 4, 1992) (Regular Operation 112
Reclamation Permit).
• Grading will be done to provide stabilized shorelines around the lakes(§Grading).
• The grading will be done to control erosion (§Grading).
• All slopes created by the mining operation will be no greater than 3H:1 V(§Grading).
• This mining operation will not adversely affect the stability of any significant, valuable
and permanent man-made structure(s) located within two hundred (200) feet of the
affected lands (§Notice to Commenters/Objectors).
DRMS Permit Approved with Conditions (October 23, 1992) (Regular Operation 112
Reclamation Permit, 83'd Joint Venture; Letter)
• Permit#M-1992-069.
• Stipulation No. 03: Operator cannot disturb, pending a stability analysis or approval by
owner, within 200 feet of man-made structures (Bellweather Oil and Gas, Boyd-Freeman
Ditch, overhead utilities, Colorado Southern Rail Road F).
Weld County Land Use Permit—Special Review Permit
• Approved October 21, 1992.
• A Flood Hazard Development Permit shall be submitted and approved by the Department
of Planning Services (p. 3).
• The Special Use Permit is located in the 100-year floodplain.
