REVEGETATION
The Division is not approving Phase III bond release for any areas that required vegetation sampling.
PROTECTION OF THE HYDROLOGIC BALANCE
An assessment of the impacts to the hydrologic balance was performed for surface water and
groundwater. The data in past AHRs and DMRs shows that mining and reclamation activities within
the SL -04 area have not had a negative impact on surface water or groundwater on or adjacent to the
Southfield Mine.
SUMMARY AND CONCLUSIONS
Based upon a review of the mine permit, the bond release application, site inspections, and other
information, the Division finds that EFCI has successfully completed all surface coal mining reclamation
operations for the areas approved for Phase III bond release in accordance with the approved reclamation
plan, and met all requirements of the Act and the Rules.
IV. BONDING
Three previous bond release applications have been submitted and approved for the Southfield Mine.
SL -01, which entailed Phase I of approximately 14 acres at the loadout, was approved on November 4,
1997 and released $26,980.00. SL -02, a Phase I release for the mine site, was approved on April 25,
2003, and $534,012.00 was released. SL -02 covered approximately 68 acres related to the facilities
area, refuse pile (RDA), Newlin Creek topsoil stockpile and south fan area. SL -03 entailed Phase I
release of 18.6 acres (loadout ponds and various areas on mine site) and Phase II and III release of
101.7 acres (all of loadout and most areas on mine site). SL -03 was approved on February 23, 2016,
and released $340,922.00.
The Division holds a performance bond of $33,787.00. The minimum amount that must be retained in
accordance with Rule 3.03.1(4) is $10,000. The Division finds that the minimum bond amount of $10,000
is sufficient to ensure the remaining reclamation of the site in the event of permit revocation and bond
forfeiture (Rule 3.03.1(3)(a) and (d).
V. PROPOSED DECISION
Based on the observations above, the Division proposes to approve EFCI's request for a Phase I, II, and
III bond release for the Southfield Mine. This proposed decision will release the applicant from liability
