PHASE III <br />REVEGETATION <br />The Division is not approving Phase III bond release for any areas that required vegetation sampling. <br />PROTECTION OF THE HYDROLOGIC BALANCE <br />An assessment of the impacts to the hydrologic balance was performed for surface water and <br />groundwater. The data in past AHRs and DMRs shows that mining and reclamation activities within <br />the SL -04 area have not had a negative impact on surface water or groundwater on or adjacent to the <br />Southfield Mine. <br />SUMMARY AND CONCLUSIONS <br />Based upon a review of the mine permit, the bond release application, site inspections, and other <br />information, the Division finds that EFCI has successfully completed all surface coal mining reclamation <br />operations for the areas approved for Phase III bond release in accordance with the approved reclamation <br />plan, and met all requirements of the Act and the Rules. <br />IV. BONDING <br />Three previous bond release applications have been submitted and approved for the Southfield Mine. <br />SL -01, which entailed Phase I of approximately 14 acres at the loadout, was approved on November 4, <br />1997 and released $26,980.00. SL -02, a Phase I release for the mine site, was approved on April 25, <br />2003, and $534,012.00 was released. SL -02 covered approximately 68 acres related to the facilities <br />area, refuse pile (RDA), Newlin Creek topsoil stockpile and south fan area. SL -03 entailed Phase I <br />release of 18.6 acres (loadout ponds and various areas on mine site) and Phase II and III release of <br />101.7 acres (all of loadout and most areas on mine site). SL -03 was approved on February 23, 2016, <br />and released $340,922.00. <br />The Division holds a performance bond of $33,787.00. The minimum amount that must be retained in <br />accordance with Rule 3.03.1(4) is $10,000. The Division finds that the minimum bond amount of $10,000 <br />is sufficient to ensure the remaining reclamation of the site in the event of permit revocation and bond <br />forfeiture (Rule 3.03.1(3)(a) and (d). <br />V. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve EFCI's request for a Phase I, II, and <br />III bond release for the Southfield Mine.
