STIPULATION 19: <br />DEWATERING WELL PERMITS MUST BE IN PLACE, AND A MINOR REVISION BE <br />SUBMITTED AND APPROVED BY THE DIVISION TO UPDATE SECTION 2.03. 10 OF <br />VOLUME 1 OF THE PERMIT APPLICATION PACKAGE, BEFORE ANY DISTURBANCE <br />ASSOCIATED WITH THE COLLOM PIT BOX CUT IS ALLOWED TO OCCUR. <br />STIPULATION 20: <br />A DISCHARGE PERMIT FOR WATER PUMPED FROM THE DEWATERING WELLS <br />MUST BE IN PLACE, AND A MINOR REVISION TO THE PERMIT SUBMITTED AND <br />APPROVED BY THE DIVISION TO UPDATE SECTION 2.03. 10 OF VOLUME 1 OF THE <br />PERMIT APPLICATION PACKAGE, BEFORE ANY DISTURBANCE ASSOCIATED WITH <br />THE COLLOM PIT BOX CUT IS ALLOWED TO OCCUR. <br />STIPULATION 21: <br />COLOWYO COAL COMPANY WILL CONSTRUCT GROUNDWATER POINT OF <br />COMPLIANCE MLC -04-02, AND CARRY OUT STANDARD WELL TESTS TO ESTIMATE <br />AQUIFER PROPERTIES. FOLLOWING COMPLETION OF THE WORK A MINOR <br />REVISION WILL BE SUBMITTED TO UPDATE THE PERMIT APPLICATION PACKAGE <br />WITH A COMPLETE DESCRIPTION OF THE WELL, AND TO UPDATE TABLES 2.04.7- <br />38, -39, -40 AND -42. MAPS IOB AND I IC SHOULD ALSO BE UPDATED. THESE <br />ACTIONS MUST BE COMPLETED BEFORE THE END OF CALENDAR YEAR 2016. <br />STIPULATION 22: <br />PRIOR TO GROUND DISTURBING ACTIVITIES FOR THE COLLOM AREA, COLOWYO <br />WILL CONDUCT ADDITIONAL BASELINE ASSESSMENTS FOR NATIONAL REGISTER <br />OF HISTORIC PLACES AND "NEED DATA" SITES LISTED IN EXHIBIT 5, ITEM 3. THE <br />RESULTS OF THIS BASELINE ASSESSMENT WILL BE SUBMITTED TO THE DIVISION <br />THROUGH A MINOR REVISION TO THE PERMIT. <br />This Decision is based on a finding that the operations will comply with all requirements of the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Rules <br />promulgated pursuant to the Act. Public notice of this proposed Decision will be published for <br />two consecutive weeks in the Craig Daily Press. If no request for a formal hearing is made <br />within thirty (30) days of the first publication of the public notice of this proposed Decision, then <br />this Decision becomes final. The Division has calculated the amount of the reclamation bond to <br />be posted as a result of PR -04. Upon the issuance of this Decision Colowyo will submit the <br />appropriate bond monies. The Application and all supporting documentation and any stipulations <br />or conditions will become a binding part of the permit. <br />No coal mining operations may be conducted on any Federal surface or coal until the Secretary <br />of the Interior has approved the proposed mining plan. <br />PR -04, Colowyo Coal Mine C1981-019 6 August 2016 <br />
