Brock Bowles -4- August 12, 2016 <br />G Substation (0.6 acres); CRDA1 Road (1.2 acres) and CRDA1 Top (1.0 <br />acres) — Cedar Creek Associates, Inc. (CCA) was contracted in 2016 to <br />evaluate these acres for Phase II bond release. Sampling was conducted <br />in June 2016 in the interest of ascertaining establishment of vegetation to <br />support the approved postmining land use and to meet the approved <br />success standard for cover in accordance with Rule 3.03.1(2)(b). See Tab <br />9. <br />Acres submitted for Phase II & III release (10.3 acres) <br />The acres requested for Phase II & III Bond release in this submittal successfully <br />achieved Phase I Bond release on October 27, 2003, with the approval of Bond Release <br />Application No. 2 (SL -02) and on November 14, 2015, with the approval of Bond Release <br />Application No. 8 (SL -08). These acres were seeded with approved seed mixes and <br />monitored/sampled as per SCC's permit requirements. Dates and seed mixes for each <br />individual area can be found in Tab 6 of this application in the 2015 Annual Reclamation <br />Report. <br />Roadside North Portal Permanent Drainage and Pond 13 (4.9 acres); <br />CBA1 Sump (0.3 acres); Ponds 6 & 10 (2.4 acres); Pond 11 (1.2 acres); <br />CBA2 Redisturbed (0.6); Pond 9 (0.4 acres) — CCA was contracted in <br />2016 to evaluate these acres for Phase II & III bond release. Sampling was <br />conducted in June 2016 in accordance with Rule 3.03.1(5) in the interest of <br />ascertaining sedimentation control facilities have vegetation coverage <br />adequate to control erosion and similar to the reclaimed area or surrounding <br />undisturbed area. Reclaimed temporary drainage control facilities shall not <br />be subject to the extended liability period of 3.02.3(2) or the bond release <br />criteria of 3.03.1(2). See Tab 9. <br />Pond 8 (0.5 acres) - DRMS approved a postmining land use change on the <br />0.5 acres associated with Pond 8 from Fish and Wildlife to Commercial on <br />February 9, 2016 with TR -68. The premining land use on these acres was <br />also commercial. This area is currently in use by the property owner, <br />Kokopelli Farms, Inc., as part of their commercial operation. Please see <br />Tab 7 for a copy of Permit Appendix page A14-5-48, landowner waiver of <br />vegetation requirements as per Rule 4.15.10(3). <br />Acres submitted for Phase III release (0.5 acres) <br />Pond 7 (0.5 acres) - CCA was contracted in 2016 to evaluate these acres <br />for Phase II & III bond release. Sampling was conducted in June 2016 in <br />accordance with Rule 3.03.1(5) in the interest of ascertaining sedimentation <br />control facilities have vegetation coverage adequate to control erosion and <br />similar to the reclaimed area or surrounding undisturbed area. Reclaimed <br />temporary drainage control facilities shall not be subject to the extended <br />liability period of 3.02.3(2) or the bond release criteria of 3.03.1(2).
