Please clarify if the tailings on which the drill pads will be constructed are acid generating <br /> and describe how the material will be handled in such a way as to prevent any unauthorized <br /> release of pollutants to the surface drainage system. <br /> 6. The Applicant is proposing to construct up to four drill pads. Please provide a brief <br /> description on how the drill pads will be constructed. Will the drill pads be constructed on <br /> level areas? Will cut and fill be required to construct the drill pads? Also, specify the volume <br /> of material which will be moved during construction of the drill pads. <br /> 7. The recently reclaimed area where prospecting operations will be conducted is susceptible to <br /> erosion. Describe the Best Management Practices which will be used to control erosion. <br /> 8. Please clarify if the proposed drill holes will penetrate the workings of the London Mine or <br /> otherwise describe how the drilling project is related to the hydrologic investigation. <br /> 9. The Applicant has acknowledged one of the efforts of the prospecting project is to bring the <br /> water discharge from the London Mine into compliance with applicable water quality <br /> standards. Pursuant to Rule 3.1.6, the Applicant must describe how the prospecting operation <br /> will remain in compliance with applicable federal and Colorado water quality laws and <br /> regulations, including statewide water quality standards and site-specific classifications and <br /> standards adopted by the Water Quality Control Commission. <br /> 10. The Division understands that as a part of the hydrogeologic investigation, MineWater will <br /> remove a blockage from within the main tunnel and will combine the existing water <br /> discharges into a single discharge. Please note that these activities are not encompassed in the <br /> review of this NOI and approval of the NOI does not grant MineWater the authorization to <br /> conduct those activities. <br /> 11. The NOI Application references remediation efforts MineWater LLC will conduct which <br /> have been approved by CDPHE/WQCD. Please clarify if this referenced approval is <br /> contained with the Consent Decree that MineWater LLC entered into or if this is a separate <br /> approval. If this approval is separate from the Consent Decree, then please provide the <br /> Division a copy of the documentation which granted approval from CDPHE/WQCD. <br /> 12. Please provide the Division with a signed copy of the Compliance Order on Consent and <br /> Settlement Agreement that MineWater entered into with CDPHE. <br />
