3.1 Lessee shall pay Lessor the following <br /> • $0.50 a CY for Sand Material that Is removed from the property <br /> • 0..00'a CY-for dumping waste fill-from-the-project - - - <br /> • $2.00 a CY for Common Fill Material that is in a stockpile near the Horton Feed <br /> Lot Office —with a minimum of 10,000 CY expected to be taken from this source. <br /> • SEE ATTACHMENT WITH MATERIAL SITE DESIGNATIONS <br /> 3.2 Payment shall be based solely on Lessee's load counts and payment shall be <br /> due thirty (30) days after Lessee receives payment from the Owner for Leased <br /> Substances incorporated into the Project. <br /> 3.3 Lessee may, without paying any additional royalty, haul clean, uncontaminated <br /> grading material to the Property. This material shall be stockpiled or placed and <br /> compacted upon the Property in an orderly manner in accordance with the <br /> reclamation plan and any permits then in effect for the Property. <br /> 4. Lessee's Rights. Lessee shall have the right to use so much of the surface and <br /> subsurface of the Lease Property as may be reasonably necessary to carry out the purposes <br /> of this Lease so long as such use does not violate any permits, regulations or laws of any <br /> federal, state or local agencies. If such use requires prior permission or approval then <br /> Lessee shall acquire such prior permission or approval before using said surface or <br /> subsurface. <br /> Lessee shall have the right to construct, use, maintain, repair, replace, store, machinery, <br /> facilities, structures, roads, tracks, haulage ways, stockpiles, utility lines and other facilities <br /> directly related to its mining operations hereunder within the Leased Property, together with <br /> all such additional rights as are reasonably necessary for the purpose of exercising its <br /> functions and operations under this Lease. <br /> 5. Reversion. Upon termination of this Lease, Lessee shall cease to have any rights or <br /> obligations with respect to the Lease Property except as provided above. <br /> 6. Removal of Lessee's Property. Upon the expiration or termination of this Lease, Lessee <br /> shall forthwith remove from the Leased Property, at its sole cost, all of the property installed <br /> by Lessee, its agents or employees. <br /> 7. Records and Reports. Lessee shall keep a reasonably accurate record of its operations <br /> conducted or related to its business on the Leased Property showing the dates and the <br /> amount of Leased Substances removed from the Leased Property. <br /> 8. Place and Manner of Payment. All sums payable to the Lessor shall be made not later <br /> than 30 days following the close of each payment period of this Agreement and shall be <br /> made payable and mailed to the Lessor at the address indicated above, or at such other <br /> place as the Lessor may hereafter designate by notice in writing to Lessee. <br /> 9. Rights of Lessor. Lessor shall have the right at all reasonable times and at Lessor's own <br /> risk and expeAse, to enter into and upon the Leased Property for the purpose of examining <br /> and inspectin he same and ascertaining whether the terms and conditions of this Lease are <br /> being carried t and performed by Lessee. <br /> 10.
