action arising out of or relating to any damage, or injury, including death of any person, or <br /> damage to property of any kind resulting from or connected with the activities of Lessee on <br /> the Leased Property pursuant to this Lease Agreement or resultind from the use or misuse of <br /> the Leased Property by Lessee, its agents or employees holding under Lessee, or any <br /> person entering the Leased Property under the invitation of Lessee. Flowever, Lessee need <br /> not indemnify or save harmless Lessor, his officers, agents, heirs, successors, assigns, <br /> relatives and employees from costs or damages to the extent resulting from the negligence <br /> or intentional acts of Lessor or his agents, contractors, other lessees, invitees, trespassers, <br /> heirs, successors, assigns, and employees. <br /> 12. Repairs and Maintenance. The Lessee covenants and agrees during the term hereof <br /> that the Lessee shall not permit rubbish, debris, waste materials, or anything detrimental to <br /> health, or likely to create a fire hazard to remain on any part of the Leased Property or to be <br /> disposed of improperly. The term "waste material" does not include raw or processed <br /> material stockpiled for sale or use in construction of the project. Any required maintenance of <br /> any shared access road to the Leased Property shall be shared equally. Lessee shall <br /> promptly repair any fence or gate Lessee damages. Lessee will replace topsoil and seed <br /> leased area at end of the term. <br /> 13. Taxes. <br /> 14.1 Lessee shall be responsible for all taxes such as occupational taxes and other <br /> taxes that arise as a result of its use of the leased property. <br /> 14.2 Lessor shall remain responsible for income taxes for rent paid and for all <br /> property taxes, installments of special assessments, mortgages, lease payments, <br /> royalties, and all other taxes, duties, liens or encumbrances related to the Leased <br /> Property during the term of this Agreement. <br /> 14. Taxes, Licenses. Lessee agrees to promptly pay all taxes, excises, license fees and <br /> permit fees of whatever nature applicable to its operations hereunder and to take out and <br /> keep current all municipal, state or federal licenses required for the conduct of its business <br /> and further agrees not to permit any of said taxes, excises, license fees or permit fees to <br /> become delinquent. <br /> 15. Licenses and Permits. Except as otherwise set forth herein, Lessor shall be <br /> responsible for obtaining all licenses, permits and other such approvals required by <br /> applicable governmental entities relating to Lessee's use of the Leased Property hereunder. <br /> Lessor agrees to cooperate fully with Lessee to obtain and maintain a permit or permits to <br /> implement the terms of this lease subject to reasonable terms and conditions and to execute <br /> all documents necessary for further approval from other jurisdictions promptly and <br /> completely. <br /> 16. Insurance. <br /> 16.1 Lessee shall, at its own expense, at all times during the terms of the Lease <br /> Agreement, maintain in full force and effect a policy or policies of insurance written by <br /> one or ore companies which will insure Lessor against liability for injury to or death <br /> of pers ns or loss of or damage to property occurring in or aboutthe Leased <br /> Prope . The liability coverage under such insurance shall be in the minimum amount <br /> Of One illion Dollars per injury and One Million Dollars per occurrence and property <br /> Lessor Initial: <br /> Ames Initial: � 3 of 6 <br />
