4. Lessee's Rights. Lessee shall have the right to use so much of the surface and
<br /> subsurface of the Lease Property as-rrfay be reasonably n2ce7gsary-to-carryout the purposes-
<br /> of this Lease so long as such use does not violate any permits, regulations or laws of any
<br /> federal, state or local agencies. If such use requires prior permission or approval then
<br /> Lessee shall acquire such prior permission or approval before using said surface or
<br /> subsurface.
<br /> Lessee shall have the right to construct, use, maintain, repair, replace, store, machinery,
<br /> facilities, roads, haulage ways, stockpiles, and other facilities directly related to its disposal
<br /> operations hereunder within the Leased Property, together with all such additional rights as
<br /> are reasonably necessary for the purpose of exercising its functions and operations under
<br /> this Lease.
<br /> 5. Reversion. Upon termination of this Lease, Lessee shall cease to have any rights or
<br /> obligations with respect to the Lease Property except as provided above.
<br /> 6. Removal of Lessee's Property. Upon the expiration or termination of this Lease, Lessee
<br /> shall forthwith remove from the Leased Property, at its sole cost, all of the property installed
<br /> by Lessee, its agents or employees.
<br /> 7. Place and Manner of Payment. All sums payable to the Lessor shall be made not later
<br /> than 30 days following the close of each payment period of this Agreement and shall be
<br /> made payable and mailed to the Lessor at the address indicated above, or at such other
<br /> place as the Lessor may hereafter designate by notice in writing to Lessee.
<br /> 8. Rights of Lessor. Lessor shall have the right at all reasonable times and at Lessor's own
<br /> risk and expense, to enter into and upon the Leased Property for the purpose of examining
<br /> and inspecting the same and ascertaining whether the terms and conditions of this Lease are
<br /> being carried out and performed by Lessee.
<br /> 9. Access. The Lessee represents and warrants to Lessor that it has the right of access,
<br /> ingress to and egress from the Leased Property for the Lessee's employees, agents, guests
<br /> and invitees, its or their suppliers of materials and furnishers of service, and its or their
<br /> equipment, vehicles, machinery and other property; and no fee, charge or toll shall be
<br /> charged directly or indirectly for access rights. In the event that any such fee, charge or toll
<br /> shall be imposed upon Lessee other than reasonable haul road maintenance expenses, then
<br /> Lessee may deduct such fee, charge, or toll expenses; from any payments otherwise due
<br /> Lessor. Lessee shall be allowed to install gated and locked access as it may require to
<br /> properly safeguard equipment, products and work area. Lessee will not block access to
<br /> existing oil/gas and feed lot tenants. Lessee will construct a temporary fence around
<br /> the area being used.
<br /> 10. Federal, State and Local Law. Lessee agrees to comply with all applicable federal,
<br /> state and local statutes, regulations and standards, including but not limited to applicable
<br /> statutes, regulations and standards relating to mining of the Leased Substances; air, water
<br /> and land pollution; disposal of liquid, solid and/or hazardous waste; and workers and
<br /> unemployment compensation.
<br /> 11. Indemnific tion of Lessor. Lessee shall indemnify and hold harmless Lessor and its
<br /> heirs, success s, and assigns, and the Leased Property, from claims, actions, or causes of
