WNW <br /> Weld County, Colorado <br /> PROJECT NO.B 1400202 <br /> o u N r Book 1 -Contract <br /> 5.3.3 Recommence Work <br /> The County shall have the right to require the Contractor to recommence Work in the area at any <br /> time, even though an investigation may still be ongoing (so long as such Work is not in violation <br /> of any Legal Requirements or Governmental Approvals). The Contractor shall promptly <br /> recommence Work in the area upon receipt of notification from the County to do so. On <br /> recommencing Work, the Contractor shall follow all applicable procedures contained in the <br /> Contract Documents and all other Legal Requirements with respect to such Work, consistent <br /> with the County's determination or preliminary determination regarding the nature of the <br /> material, resources, species or condition. <br /> 5.4 Obligation to Minimize Impacts <br /> The Contractor shall ensure that all of its Activities and the Activities of all Contractor-Related <br /> Entities are undertaken in a manner that will minimize the effect on surrounding property and the <br /> public to the maximum extent practicable. <br /> 5.5 Quality Management <br /> 5.5.1 Contractor Quality Management <br /> The Contractor shall perform the quality management necessary for the Contractor to comply <br /> with its obligations under the Contract Documents. <br /> 5.5.2 Oversight, Verification,Inspection, and Testing by the County and Others <br /> All materials and each part or detail of the Work shall also be subject to oversight, verification <br /> and testing by the County and other Persons designated by the County. Contractor shall not be <br /> relieved of obligations to perform the Work in accordance with the Contract Documents, or any <br /> of its Warranty obligations, by oversight, spot checks, audits, verifications, reviews, tests, <br /> inspections, acceptances or approvals performed by any Persons, or by any failure of any Person <br /> to take such action. The Contractor hereby consents to such oversight, inspection and testing. <br /> Upon request from the County, the Contractor shall furnish information to such Persons as are <br /> designated in such request and shall permit such Persons access to the Site and all parts of the <br /> Work. Oversight, verification, audit, inspection and/or testing do not make any Person who <br /> performs such oversight,verification, audit, inspection and/or testing a party to the Contract nor <br /> will it change the rights of the parties hereto. <br /> When any Utility Owner is to accept or pay for a portion of the cost of the Work, its respective <br /> representatives have the right to oversee, verify, audit, inspect and test the Work. <br /> 5.5.3 Obligation to Uncover Finished Work <br /> At all times before Final Acceptance, the Contractor shall remove or uncover such portions of <br /> the finished construction Work as directed by the County. After examination by the County, the <br /> Contractor shall restore the Work to the standard required by the Contract Documents. If the <br /> Work exposed or examined is not in conformance with the requirements of the Contract <br /> 28 <br />
