Book 1 - Contract <br /> 3' <br /> 5.0 CONTROL OF WORK <br /> 5.1 Control and Coordination of Work <br /> The Contractor shall be solely responsible for and have control over the construction means, <br /> methods, techniques, sequences,procedures, and Site safety, and shall be solely responsible for <br /> coordinating all portions of the Work under the Contract Documents, subject, however, to all <br /> requirements contained in the Contract Documents. <br /> 5.2 Safety <br /> The Contractor shall take all reasonable precautions and be solely responsible for the safety of, <br /> and shall provide protection to prevent damage, injury, or loss to, all persons on the Site or who <br /> would reasonably be expected to be affected by the Work, including individuals performing <br /> Work, employees of the County and its consultants, visitors to the Site and members of the <br /> public who may be affected by the Work. The Contractor shall at all times comply with its <br /> Safety Management Plan. The Contractor shall immediately notify the County if the Contractor <br /> believes that any Contract requirement creates a safety risk. <br /> 5.3 Process to be Followed for Discovery of Certain Site Conditions <br /> 5.3.1 Notification to the County <br /> If the Contractor becomes aware of: (i) any on-Site material that the Contractor believes may <br /> contain Hazardous Substances that is required to be removed or treated; (ii) any paleontological, <br /> cultural or biological resources; or(iii) any Differing Site Conditions, as a condition precedent to <br /> the Contractor's right to a Change Order, the Contractor shall immediately notify the County <br /> thereof by telephone or in person, to be followed by written notification as soon as practicable. <br /> The Contractor shall immediately stop Work in and secure the area. In such event, the County <br /> will view the location within two Working Days of receipt of notification, and will advise the <br /> Contractor at that time whether to resume Work or whether further investigation is required. <br /> Any delay resulting from the County viewing the location up to two Working Days shall not be <br /> considered a the County-Caused Delay. <br /> 5.3.2 Further Investigation <br /> The Contractor shall promptly conduct such further investigations as the County deems <br /> appropriate. Within five Working Days after its initial notice to the County, the Contractor shall <br /> advise the County of any action recommended to be taken regarding the situation in writing. If <br /> Hazardous Substances are involved, the notice shall describe the type of Remediation Work, if <br /> any, which the Contractor proposes to undertake with respect thereto. If paleontological, <br /> cultural, or biological resources are present, the notice shall advise the County what course of <br /> action the Contractor intends to take with respect thereto and whether the location should be <br /> fenced off or whether Work can resume. The County then will determine whether the <br /> Contractor's findings and proposed actions are acceptable and, in writing, either Approve, or <br /> require modification of, the Contractor's proposed actions. <br /> 27 <br />
